These Terms and Conditions (“Terms”) govern your access to and use of the Popmenu websites, subdomains, mobile applications (collectively, the “Popmenu Sites”), and the websites of our clients that are built, hosted, or powered by Popmenu (collectively, the “Client Sites”). By accessing or using the Popmenu Sites or Client Sites, you agree to these Terms. If you do not agree, you must stop using the Sites immediately.
1. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Popmenu Sites or Client Sites. By using the Sites, you confirm that you meet these requirements.
2. Accounts and Registration
To access certain features, you may need to create a Popmenu account or a Client Site account.
You are responsible for keeping your account login details confidential and for all activity under your account.
You must provide accurate and up-to-date information when registering and promptly update it if anything changes.
3. Use of Services
When using the Popmenu Sites or Client Sites, you agree that you will:
Only use the Sites for lawful purposes.
Not attempt to disrupt or harm the Sites or services.
Not use the Sites to distribute spam, malware, or offensive material.
Not copy, modify, resell, or exploit any part of the Popmenu services without written permission.
Follow all applicable laws, including privacy, data protection, and marketing rules.
4. Orders and Payments
If you place an online order or purchase services through Popmenu, you must provide valid payment information.
All payments are subject to applicable taxes and fees.
Refunds, if applicable, are handled by the client (restaurant or business) providing the service, not Popmenu.
5. User Content (Reviews, Ratings, Comments)
By submitting reviews, ratings, or other content (“User Content”) on a Client Site, you grant Popmenu and the applicable client a non-exclusive, royalty-free license to use, display, and distribute your content.
You are fully responsible for your User Content. You represent that your content does not violate the rights of others or break any laws.
Popmenu reserves the right to remove any User Content that violates these Terms or is otherwise inappropriate.
6. Intellectual Property
All trademarks, logos, software, designs, and content on the Popmenu Sites belong to Popmenu or its licensors.
You are granted a limited, non-transferable license to use the Sites for personal, non-commercial purposes only.
Unauthorized use of Popmenu’s intellectual property is prohibited.
7. Third-Party Links and Services
The Sites may contain links to third-party websites or services. Popmenu is not responsible for the content, policies, or practices of third parties. Your dealings with third-party services are strictly between you and that third party.
8. Termination
Popmenu may suspend or terminate your access at any time if you violate these Terms or applicable laws.
You may stop using the Sites at any time by closing your account and discontinuing use.
9. Disclaimers and Limitation of Liability
The Sites and services are provided “as is” and “as available” without warranties of any kind.
Popmenu does not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, Popmenu is not liable for indirect, incidental, or consequential damages.
Popmenu’s total liability to you will not exceed the amount you paid for services in the 12 months before the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless Popmenu, its affiliates, employees, and partners from any claims, damages, or expenses arising from your use of the Sites, your User Content, or your violation of these Terms.
11. Privacy
Your use of the Sites is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
12. Changes to Terms
We may update these Terms from time to time. If we make significant changes, we will notify you on the Sites or by other means. Your continued use after changes means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Georgia, United States. You agree to the exclusive jurisdiction of the courts located in Georgia to resolve any disputes.
