By accessing our website, creating an account, or utilizing the LeadCatcher software system and related mobile applications (collectively, the "Service"), you agree to be bound by these Terms & Conditions. Please read them carefully.

1. Scope of Service

LeadCatcher provides automated lead-capture, communication triage, and text-back software solutions. The Service is designed to assist businesses ("Users") in filtering, qualifying, and routing inbound inquiries. LeadCatcher acts strictly as a technology provider and does not guarantee a specific volume of leads or conversion rates.

2. Lawful Use & Compliance

You agree to use the Service only for lawful business operations. You are solely responsible for ensuring that your business practices, including your communication with prospective clients, comply with all local regulations, including the UK Data Protection Act, UK GDPR, and the Privacy and Electronic Communications Regulations (PECR).

3. Mobile Verification & Telecom Regulations

To activate and maintain the Service’s virtual text-back functionality, you agree to provide authentic registration documentation (such as Companies House registry or valid sole trader identification) required by Ofcom and mobile network operators. LeadCatcher reserves the right to suspend accounts immediately if a telecom carrier flags verification data as incomplete or non-compliant.

4. Intellectual Property

All software workflows, custom AI prompts, branding, graphics, text, and proprietary system architectures utilized within LeadCatcher are the exclusive property of LeadCatcher and its licensors. Your subscription grants you a limited, non-transferable license to use the Service for your internal business operations; it does not grant ownership or the right to replicate the system backend.

5. Payment, Billing, and Lead Wallets

Currency: All subscription fees, implementation costs, and usage fees are quoted and processed exclusively in British Pounds (£).

Subscriptions: Recurring fees are charged automatically on a monthly basis according to your selected tier.

Usage Charges (Lead Wallet): Variable fees for SMS text-back routing and automated triage logic are deducted from your account’s integrated "Lead Wallet." You authorize LeadCatcher to process auto-top-ups as configured to ensure continuous service availability.

Refunds: Because the Service incurs immediate provisioning and carrier fees, refunds are handled strictly on a case-by-case basis and are subject to our primary service agreement.

6. Limitation of Liability & Technical Safe Harbor

LeadCatcher functions as an automated communication safety net. While we strive for 100% platform uptime, we rely on third-party telecommunications networks, mobile carriers, and hosting providers.

LeadCatcher will not be liable for any direct, indirect, or consequential loss of business, revenue, or contracts arising out of:

Intermittent network or system downtime.

Carrier-side delivery delays or filtered text messages.

Homeowner inquiries that fail to complete the automated qualification sequence.

7. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of the use of this Service shall be subject to the exclusive jurisdiction of the English courts.
