By accessing or using the services provided by National Data Compliance Group ("NDCG," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
NDCG provides three distinct services:
● Data Furnishing: The transmission of consumer payment history to Credit Reporting Agencies (CRAs) via Switch Labs infrastructure.
● Forensic Audits: The analysis of consumer credit reports for Metro 2® compliance errors.
● Wholesale Fulfillment: Back-office processing for third-party agencies.
You agree that any information you provide to NDCG for the purpose of auditing or furnishing is accurate to the best of your knowledge.
● For Furnishers: You warrant that the debt data you upload is valid, verifiable, and not subject to pending litigation.
● For Consumers: You warrant that you are the individual named in the credit file and are not acting on behalf of a third party without Power of Attorney.
● Audit Fees: The $499 Forensic Audit Fee is a non-refundable "Service Initiation & Analysis Fee." This fee covers the generation of the Metro 2® Analysis Report.
● Setup Fees: All B2B Setup Fees ($2,500 Furnisher / $297 Wholesale) are non-refundable once the Onboarding Portal credentials have been issued.
NDCG is not responsible for the decisions made by third-party Credit Reporting Agencies (Equifax, Experian, TransUnion). We cannot guarantee the deletion of any specific item. Our liability is strictly limited to the amount paid for the service.
These terms are governed by the laws of the State of California. Any disputes shall be
resolved in the jurisdiction of San Joaquin County.
