These Terms of Service (“Terms”) govern your access to and use of this website, landing page(s), donation page(s), and any related content, digital resources, tools, downloads, and services (collectively, the “Site” and “Services”) operated by:

By accessing the Site, clicking “Donate Now,” contributing funds, or using any part of the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1) Eligibility
You must be at least 18 years old (or the age of legal majority where you live) to use the Services and make a contribution.
2) What This Site Does
The Site enables you to:
Contribute money intended to be used to purchase physical books, which we then donate to recipients described on the Site (the “Book Donation Program”); and/or
Receive access to certain digital resources described on the Site (e.g., toolkits, downloads, “vault” content, prompts, templates, training materials) (the “Digital Content”), if offered in connection with your contribution.
We may update, change, pause, or discontinue any part of the Services at any time.
3) Contributions Are Not Charitable Donations Unless Explicitly Stated
Even if the Site uses words like “donate” or “donation,” your payment is treated as a contribution to support a book-gifting program, not automatically a tax-deductible charitable donation.
Tax deductibility is not guaranteed.
No tax advice is provided.
If you need a tax deduction, you are responsible for verifying whether it applies in your situation.
4) How Contributions May Be Used
By contributing, you understand and agree your funds may be used for costs associated with operating the Book Donation Program and delivering the Services, including (without limitation):
Purchasing physical books
Shipping, packaging, and delivery logistics
Payment processing fees, platform fees, software costs
Administrative and operational costs required to manage the program
Digital Content creation, hosting, and delivery
We aim to use contributions in good faith for the program described, but we do not guarantee that every dollar goes exclusively to the cost of books, because real-world delivery includes unavoidable fees and logistics.
5) Book Donation Program Logistics
You acknowledge and agree that:
Recipients may vary depending on availability, need, location, shipping constraints, and partnering opportunities.
We may donate books through direct shipping, community organizations, schools, nonprofits, or other distribution channels.
Specific outcomes are not guaranteed, including (but not limited to): exact number of books purchased per contributor, exact recipients, delivery times, geographic destination, or proof-of-delivery per individual contribution.
We may substitute titles, editions, formats, or suppliers if needed due to availability, pricing, or shipping constraints, while keeping the spirit of the program intact.
6) Digital Content License and Restrictions (If Included)
If your contribution includes access to Digital Content:
You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the Digital Content for your own lawful purposes.
You may not copy, resell, redistribute, publish, share, or make the content available to others (including sharing logins, links, files, or downloads).
“Lifetime Access” Definition
If “lifetime access” is stated, it means access for as long as we continue to maintain and offer the Digital Content and/or the platform hosting it. It does not mean we must keep the content available forever or provide future products for free.
7) Payments and Authorization
By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize us (and our payment processors) to charge the amount shown at checkout.
We may use third-party payment processors, and your payment may also be governed by the processor’s terms and privacy practices.
8) Refund Policy (Important)
Because your contribution supports a real-world book-purchasing and donation program and may also unlock immediate digital access:
All contributions are final and non-refundable, except where required by applicable law.
If you believe you were charged incorrectly or fraud occurred, contact us promptly with your transaction details so we can review.
We reserve the right to deny refund requests where we reasonably suspect abuse, excessive refund attempts, or chargeback fraud.
9) No Earnings or Results Guarantees
Any strategies, prompts, training, examples, and educational materials are provided for informational and educational purposes only.
We do not guarantee any business results, income, profits, audience growth, job outcomes, or performance improvements. Results vary based on many factors outside our control.
10) Prohibited Uses
You agree not to:
Use the Services for illegal, deceptive, or fraudulent activity
Attempt to hack, scrape, reverse engineer, disrupt, or interfere with the Site
Share, resell, republish, or redistribute Digital Content
Misrepresent your identity or payment authorization
We may suspend or terminate your access if we believe you have violated these Terms.
11) Intellectual Property
All Site content and Services—including text, graphics, branding, downloads, prompts, templates, videos, and training materials—are owned by us or licensed to us and protected by intellectual property laws.
No rights are granted except the limited license explicitly stated in these Terms.
12) Third-Party Links and Services
The Site may link to third-party tools, platforms, or websites. We do not control them and are not responsible for their content, policies, availability, or practices. Use them at your own risk.
13) Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted service, error-free operation, or that the Site will be free from harmful components.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIKE HOLMES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID IN THE TRANSACTION GIVING RISE TO THE CLAIM (OR $100, WHICHEVER IS GREATER), UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15) Indemnification
You agree to indemnify and hold harmless Mike Holmes from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party rights.
16) Termination
We may terminate or suspend access to the Services at any time if you violate these Terms or if we reasonably believe fraud or abuse is involved.
Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Terms) will survive.
17) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” will reflect the current version. Your continued use of the Site after changes means you accept the updated Terms.
18) Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles.
19) Disputes and Venue
If a dispute arises, you agree to contact us first to attempt informal resolution.
If not resolved, any legal action must be brought in the state or federal courts located in Utah, and you consent to jurisdiction and venue there, unless applicable law requires otherwise.
