Lariene Orillion Photography Terms of Service & User Agreement

1. Acceptance of Terms
The following “Terms of Service” governs your use of the website https://larieneorillionphotography.com (“Site”) and the photography services provided by Lariene Orillion Photography (“we,” “our,” or “us”). This is a binding agreement between you and Lariene Orillion Photography and incorporates our Privacy Policy at https://larieneorillionphotography.com/privacy-policy.
By using our Site or booking photography services (“Services”), you agree to be bound by these Terms.
We reserve the right to change these Terms from time to time. When changes occur, we will post an updated date at the top of this page and may provide notice through our Site or by email. Your continued use of our Site and Services after changes have been posted constitutes acceptance of the revised Terms.
As used in these Terms, references to our “Affiliates” include our owners, licensees, assigns, subsidiaries, affiliated companies, officers, directors, contractors, partners, and service providers.

2. Services
Lariene Orillion Photography provides professional photography services, including but not limited to portraits, family sessions, events, weddings, and commercial shoots. Service details, session times, and deliverables will be outlined in your booking confirmation or contract.
a. No Guarantee
While we strive to provide high-quality photography, we cannot guarantee specific results or outcomes, as image results may vary depending on location, weather, lighting conditions, and other factors beyond our control.
b. Temporary Interruptions
You understand and agree that occasional interruptions may occur due to technical issues, equipment failure, or unforeseen circumstances. We are not liable for delays outside our reasonable control.
c. Right to Modify Services
We reserve the right to make changes to our Services, packages, or pricing at any time, provided such changes do not affect bookings already confirmed with a signed contract and/or paid retainer.
3. Payment
a. Fees
To secure your session date, a non-refundable retainer is required at booking. The remaining balance is due by the date specified in your contract. Payments may be made through cash, check, or secure third-party payment providers.
b. Overdue Payments
If payment is not received by the due date, we reserve the right to delay delivery of images or suspend Services until the balance is paid in full.
c. All Payments Non-Refundable
All retainers and payments are non-refundable except in cases where we must cancel your session and cannot reschedule.
4. Client Conduct & Responsibilities
By booking with Lariene Orillion Photography, you agree to:
Arrive on time for your session.
Provide accurate information about your booking and participants.
Ensure locations are accessible and any required permits are obtained.
Treat our team and equipment with respect.
We reserve the right to stop a session if unsafe or inappropriate conditions occur.
5. Intellectual Property
a. Ownership of Content
All photographs taken by Lariene Orillion Photography remain the copyrighted property of the photographer.
b. Client Usage Rights
Clients receive a personal-use license for delivered images unless otherwise agreed in writing. Commercial use requires a separate licensing agreement. Images may not be altered, sold, or used for advertising without written consent.
c. Photographer Usage Rights
With your written or electronic consent, we may use images from your session for our portfolio, website, social media, or promotional materials.
6. Privacy & Security
Your personal information will be handled in accordance with our Privacy Policy. We do not share or sell your information, and images will only be shared publicly with your consent.
7. Limitation of Liability
Our liability for any claims related to your booking shall not exceed the total amount you paid for the Services. We are not liable for:
Weather conditions or venue restrictions
Missed shots due to lateness or non-cooperation
Loss of images due to events beyond our control (e.g., theft, equipment failure, acts of God)
8. Termination of Services
We may terminate a booking if:
The client breaches these Terms
Unsafe or inappropriate behavior occurs
Payment is not received as agreed
In such cases, no refunds will be issued.
9. Governing Law
These Terms are governed by the laws of the State of Louisiana. Any disputes will be resolved in the appropriate state or federal court located in Louisiana.
