In June 2025, federal prosecutors in the Southern District of Florida charged Marlen Veliz Rios of Hialeah, Florida, in connection with a large Medicare fraud scheme involving wound-care and skin-graft billing. According to the indictment, Rios operated a clinic called Loves Community Health and caused the submission of approximately $15.3 million in fraudulent claims to Medicare, of which more than $10 million was paid out. Federal investigators allege that the clinic billed Medicare for wound-care treatments and skin-graft products that were medically unnecessary or never provided at all. Prosecutors further stated that after receiving the Medicare payments, Rios transferred the money through multiple accounts, including shell companies, and used the funds for personal benefit rather than legitimate medical services.
The case highlights why medical necessity and proper documentation are central to Medicare coverage policies such as Local Coverage Determinations (LCDs). Investigators alleged that many of the claims submitted by the clinic involved patients who did not have legitimate wounds that required advanced skin-graft treatments, and in some instances the claims referenced services that were not provided as billed. These practices violate Medicare’s requirements that treatments be supported by accurate medical records demonstrating real clinical need. According to prosecutors, schemes like this not only defraud federal healthcare programs but also undermine trust in legitimate wound-care treatments. Cases involving medically unnecessary procedures and fabricated claims are a major reason federal regulators and law-enforcement agencies continue to increase oversight and enforcement in the wound-care and skin-substitute industry.
