These Terms of Service ("Terms") govern your use of the website, landing pages, forms, and communications operated by Browns Inshore Guide Service ("we," "us," or "our"), owned and operated by Captain Dave Brown in Orange Beach, Alabama. By submitting a form, booking a trip, or otherwise engaging with our services, you agree to these Terms.

1. Services

Browns Inshore Guide Service provides guided light tackle inshore fishing trips on the Alabama Gulf Coast and surrounding waters. All trips are subject to availability, weather conditions, and applicable state and federal fishing regulations.

2. Bookings and Reservations

Submitting a booking inquiry form does not constitute a confirmed reservation. A booking is confirmed only when Captain Dave Brown has personally communicated confirmation to you via phone, text, or email. We reserve the right to decline any booking at our discretion.

3. Deposits and Payments

Deposit and payment terms will be communicated at the time of booking confirmation. All payment terms are subject to change and will be agreed upon between the client and Captain Dave Brown prior to the trip date.

4. Cancellations and Weather Policy

Captain Dave Brown reserves the sole right to cancel or reschedule a trip due to unsafe weather conditions, including but not limited to lightning, high winds, or other conditions deemed hazardous. In the event of a captain-initiated cancellation due to weather:

• Any deposit paid will be fully refunded or applied to a rescheduled trip at the client's preference.
• We will make reasonable efforts to offer an alternative date or time slot.

If a client chooses to cancel a trip for personal reasons unrelated to safety or weather, cancellation and refund terms will be determined at the time of booking. Clients who decline to participate in a trip that the captain has determined to be safe and fishable may forfeit any deposit paid.

5. Fishing Regulations and Licensing

All trips are conducted in compliance with Alabama and Florida state fishing regulations. Clients are responsible for obtaining any required personal fishing licenses prior to the trip unless otherwise arranged. Captain Dave Brown is fully licensed and insured to operate as a guide in the applicable jurisdictions.

6. Assumption of Risk

Fishing and boating activities involve inherent risks. By booking a trip with Browns Inshore Guide Service, you acknowledge and accept these risks. We are not liable for injuries, accidents, or losses that occur during a trip, except in cases of gross negligence on the part of the captain.

7. SMS Communications

By providing your phone number and checking the SMS consent checkbox on our forms, you agree to receive text messages from Browns Inshore Guide Service. We offer two categories of SMS communications:

• Non-marketing messages: Trip confirmations, booking updates, reminders, and service-related communications.
• Marketing messages: Promotional offers, discounts, and seasonal updates, where you have provided separate consent.

Message and data rates may apply. Reply STOP to opt out of any SMS messages at any time. Reply HELP for assistance. Opting out of marketing messages will not affect your ability to receive non-marketing service messages related to a confirmed booking.

8. Email Communications

By submitting a form on our website or landing pages, you agree to receive email communications from Browns Inshore Guide Service, including the requested content (such as our free guide), trip-related information, and periodic marketing messages. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any email we send.

9. Intellectual Property

All content on our website and landing pages, including text, images, logos, and guides, is the property of Browns Inshore Guide Service and may not be reproduced or distributed without written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Browns Inshore Guide Service shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services, website, or communications.

11. Governing Law

These Terms are governed by the laws of the State of Alabama. Any disputes arising under these Terms shall be resolved in the appropriate courts of Baldwin County, Alabama.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of our services after any changes constitutes your acceptance of the updated Terms.
