Terms and Conditions

These Terms and Conditions ("Terms") govern the relationship between Mira Staffing ("we", "us", "our") and the individuals and companies ("you", "your") utilizing our staffing services. By engaging with our services, you agree to be bound by these Terms.

1. Services Provided

Mira Staffing offers staffing and recruitment services, including but not limited to temporary, contract, and permanent placement of candidates in various industries. The scope of services will be specified in individual contracts or service agreements with each client.

2. Client Responsibilities

- Job Descriptions: Clients must provide accurate and complete job descriptions, requirements, and conditions of employment. Mira Staffing is not responsible for inaccuracies in the job details provided by clients.

- Work Environment: Clients must ensure that the work environment complies with all applicable health and safety laws.

- Hiring Decisions: The final hiring decision remains the client's responsibility. Mira Staffing will not be held liable for any outcomes resulting from the client’s choice of candidates.

3. Candidate Placement

- Candidate Representation: Mira Staffing makes every effort to present qualified candidates. However, we do not guarantee specific results regarding the candidates' performance, qualifications, or suitability.

- Temporary Placements: Temporary or contract staff are deemed employees of Mira Staffing unless otherwise agreed. Clients are responsible for supervising temporary staff and ensuring that they adhere to company policies during the placement period.

- Direct Hires: For permanent placement, clients agree to pay Mira Staffing a placement fee as specified in the service agreement. This fee is due upon the candidate's hire unless otherwise agreed.

4. Fees and Payments

- Service Fees: All fees will be outlined in the service agreement signed by both parties. These fees may include temporary staffing rates, recruitment fees, or other charges related to the services provided.

- Payment Terms: Invoices are due within [insert payment term, e.g., 30 days] of receipt. Late payments may incur interest charges as detailed in the service agreement.

- Refunds/Replacement Guarantee: Any refund or replacement guarantee will be detailed in the service agreement. Typically, we offer a replacement candidate if a permanent placement leaves within [insert time period, e.g., 90 days], provided the client has adhered to the terms of payment.

5. Confidentiality

Both parties agree to keep any confidential information, including but not limited to candidate details, client information, and business practices, private and secure. Confidential information may not be disclosed to third parties without prior written consent unless required by law.

6. Non-Solicitation

Clients agree not to solicit or hire Mira Staffing employees, consultants, or any candidate presented by Mira Staffing for a period of [insert duration, e.g., 12 months] from the last interaction unless otherwise agreed in writing. A breach of this clause will result in a fee as detailed in the service agreement.

7. Liability Limitation

- Mira Staffing shall not be liable for any indirect, incidental, or consequential damages arising from the use of our staffing services.

- Our liability, if any, for direct damages shall not exceed the total fees paid by the client within the [insert time frame, e.g., 6 months] preceding the claim.

8. Termination

Either party may terminate the service agreement by providing [insert notice period, e.g., 30 days] written notice. Upon termination, all outstanding fees become immediately due and payable.

9. Governing Law

Mira Staffing reserves the right to amend these Terms at any time. Clients will be notified of any significant changes, and continued use of our services after amendments constitutes acceptance of the updated Terms.
