Terms and Conditions (T&C) of Lighthouse Media Agency

1. General

1.1 These Terms and Conditions (T&C) govern the contractual relationship between Lighthouse Media Agency (hereinafter "we", "us" or "Lighthouse Media Agency") and the customer (hereinafter "Customer"). They apply to all contracts and services concluded through our website or in the context of agreements with our business partners, including lead generation, B2B marketing, and B2C marketing.

1.2 These T&C apply to the purchase of services through our brands in both the B2B and B2C sectors, whereby conditions may vary depending on the respective business segment.

1.3 By using our services or entering into a contract with us, the Customer accepts these T&C.

1.4 We reserve the right to change these T&C at any time. Changes will be communicated to the Customer at least 14 days before they take effect. If the Customer does not object within this period, the changes are deemed accepted.

2. Conclusion of Contract

2.1 The contract between Lighthouse Media Agency and the Customer is concluded when the Customer signs the contract after a consultation or submits a binding order. This applies to B2B services (purchase of leads) as well as B2C services (lead distribution and generation for our partners).

2.2 Our offers are non-binding. The contract only becomes effective upon the Customer's signature or upon confirmation of the order by us. The details and prices specified in the contract apply.

2.3 Lead generation is carried out as part of targeted marketing campaigns conducted specifically for or on behalf of the Customer. All details regarding lead generation, including the number of leads, their quality, and the agreed pricing structure, are defined in a separate agreement.

2.4 If a specific contract term or duration applies to a service, this will be individually agreed upon in the contract.

3. Services

3.1 Our services include lead generation for B2B customers (purchase of leads) as well as B2C marketing through our own brands in order to forward leads to suitable partners. We support lead acquisition through various marketing strategies, such as SEO, content marketing, PPC, and social media.

3.2 Our B2B services involve selling leads to business customers who use these leads to expand their customer base.

3.3 In the B2C sector, we provide marketing services that allow our brands to generate leads, which are then forwarded to contractual partners. The contact details of B2C customers are only forwarded to authorized partners.

3.4 Our lead generation does not include any guarantee of specific sales figures or conversion rates. The success depends on many factors that are beyond our control.

4. Payment Terms

4.1 Payment for all services is made by bank transfer after invoicing to the account specified in the contract. Our invoices must be paid within 14 days of the invoice date without deduction, unless otherwise agreed.

4.2 In the B2B sector, payment is made on the basis of the purchase of leads. The price per lead is defined individually in the contract, depending on the number of leads and the specific marketing service.

4.3 For B2C leads, the data is forwarded to our partners. In such cases, no direct payment is made by B2C customers to Lighthouse Media Agency.

4.4 If the Customer is in default of payment, we reserve the right to charge reminder fees and to terminate the contract without notice.

4.5 All payments are to be made in euros. Any bank or transfer fees are to be borne by the Customer.

5. Right of Withdrawal and Returns

5.1 The Customer has the right to withdraw from the contract within 14 days of its conclusion without stating reasons if it is a distance contract. However, if Lighthouse Media Agency has already begun providing services (e.g., lead generation or marketing campaigns), the right of withdrawal only exists if the Customer has not yet received any services after the contract began.

5.2 In the B2B sector, withdrawal rights are limited and may apply only in specific cases in accordance with the terms of the individual contract. If the Customer no longer requires the leads or wishes to cancel the contract after payment, the contractually agreed terms regarding cancellation apply.

5.4 Leads cannot be returned, as they are generated and provided specifically for the Customer.

6. Liability and Warranty

6.1 Lighthouse Media Agency is not liable for specific results arising from the use of leads or marketing measures. Our services are limited to generating leads, and we do not guarantee specific sales or conversion outcomes.

6.2 We take all necessary steps to deliver high-quality leads. However, no guarantee is provided regarding quality, conversion likelihood, or success.

6.3 Liability for damages caused intentionally or by gross negligence remains unaffected. In the case of simple negligence, we are only liable if an essential contractual obligation is breached.

6.4 Our liability is limited to the amount of the agreed compensation for the respective service, unless a broader liability is required by law.

7. Data Protection and Data Security

7.1 We take the protection of personal data seriously and process such data only in accordance with the applicable data protection laws (in particular, the GDPR). Personal data is collected and processed only for fulfilling the contract, responding to inquiries, or processing payments.

7.2 Personal data collected via contact forms may be forwarded to trusted partner companies solely for the purpose of fulfilling the Customer's request or providing the agreed service. Data will only be forwarded where necessary or where prior consent has been given. Consent may be revoked at any time.

7.4 B2C contact data is only forwarded to partner companies if necessary for contract performance and only with explicit consent.

7.5 Customers may request information regarding the data stored about them or request deletion, provided there is no statutory obligation to retain the data.

8. Customer Rights and Obligations

8.1 The Customer agrees to provide us with all information necessary for performing the contract, particularly data relevant to lead generation and marketing.

8.2 The Customer is responsible for ensuring that the information provided is accurate. If incorrect or incomplete data is provided, we reserve the right to refuse service or terminate the contract without notice.

8.3 The Customer must make payments on time and notify us immediately of any changes to their contact or business details.

9. Jurisdiction and Applicable Law

9.1 German law applies to all legal relationships between us and the Customer.

9.2 The place of jurisdiction for all disputes arising from this contract is Düsseldorf, provided the Customer is a merchant.

10. Final Provisions

10.1 If any provision of these T&C is invalid or unenforceable, the validity of the remaining provisions remains unaffected.

10.2 These T&C constitute the entire agreement between Lighthouse Media Agency and the Customer. Amendments and supplements must be made in writing.
