“Filipino Courts, Filipino Justice System”: Bakit Umiinit ang Pahayag ni Gringo Honasan

Hindi na simpleng legal debate ang usapin ng ICC para sa maraming Pilipino.

Para sa ilan, usapin ito ng accountability at rule of law.

Pero para naman sa iba, usapin ito ng dignity at independence ng bansa.

Kaya nang sabihin ni Honasan na:

“Filipino courts, Filipino justice system, Filipino citizen,”

maraming supporters ng dating administrasyon ang nakakita rito bilang depensa sa kakayahan ng Pilipinas na resolbahin ang sariling mga kaso nang hindi umaasa sa foreign intervention.

At sa totoo lang, malalim ang emotional weight ng ganitong argumento sa isang bansang matagal nang sensitibo pagdating sa usapin ng foreign influence.

Ang pinakamalaking tanong ngayon ay hindi lang kung may jurisdiction ba ang ICC.

Mas malaking usapin:
May sapat bang tiwala ang publiko sa sariling justice system ng bansa?

Ayon kay Honasan, kung hindi kayang magbigay ng hustisya ng bansa para sa dating Pangulo, paano pa raw makakaasa ang ordinaryong mamamayan sa patas na hustisya?

At dito tumatama ang mas malalim na concern ng publiko.

Dahil sa mata ng maraming Pilipino, ang issue ay hindi lang legal interpretation.

Issue rin ito ng national confidence.

May mga naniniwalang dapat pairalin ang sariling hudikatura bago umasa sa international courts.

Pero mayroon ding nagsasabing mahalaga ang international accountability mechanisms kapag may mga kasong hindi madaling maresolba sa loob ng bansa.

Sa huli, maaaring magkaiba ang pananaw ng mga tao tungkol sa ICC.

Pero halos lahat ay may iisang hangarin:
isang sistemang panghustisya na patas, mapagkakatiwalaan, at tunay na nagsisilbi sa mamamayan.

Dahil sa isang malayang bansa, mahalaga ang accountability.

Pero kasinghalaga rin ang tiwala ng mamamayan sa sariling institusyon.
