These Terms & Conditions (“Terms”) govern all services provided by Ryan Adams Videographer & Photographer (“we,” “our,” or “us”) to clients (“you” or “client”). By booking our services, you agree to these Terms.
1. Booking & Payment
A signed agreement and non-refundable retainer (percentage or flat fee) are required to secure your date.
Remaining balance must be paid in full before delivery of final work, unless otherwise agreed in writing.
Bookings are confirmed only after receipt of retainer and written confirmation.
2. Cancellations & Rescheduling
Retainers are non-refundable.
If you cancel more than 30 days prior to the scheduled date, you may reschedule subject to availability.
Cancellations within 20 days of the event/session will result in forfeiture of all payments made.
If we are unable to perform due to illness, emergency, or unforeseen circumstances, a suitable replacement will be arranged or a full refund provided.
3. Client Responsibilities
You are responsible for obtaining all necessary permissions, permits, or access required for photography/videography.
You must ensure cooperation of guests, vendors, and participants to allow coverage of your event/session.
For events, a meal and reasonable break periods must be provided for sessions exceeding 6 hours.
4. Creative Rights
We retain full creative control over style, editing, and artistic approach.
Final edited images and videos are delivered at our professional discretion; raw/unedited files are not released.
5. Copyright & Usage
Copyright: All images and videos remain the intellectual property of Ryan Adams Videographer & Photographer.
Client Use: You are granted a personal, non-commercial license to use delivered media for personal use (printing, sharing, social media, etc.).
Commercial Use: Requires a separate written agreement and licensing terms.
Promotional Rights: We reserve the right to use images and videos for our portfolio, website, advertising, and promotional purposes unless otherwise agreed in writing.
6. Delivery
Standard turnaround is TBD for photography and TBD for videography, unless otherwise stated.
Delivery is via secure online gallery, USB, or other agreed-upon method.
We are not liable for loss/damage of digital files once delivered. Clients are responsible for creating backups.
7. Liability
While every effort will be made to capture important moments, we cannot guarantee coverage of every specific event or person.
We are not responsible for compromised coverage due to restrictions at locations, interference from guests/vendors, weather conditions, or other circumstances beyond our control.
Liability is limited to the amount paid for services.
8. Privacy & Confidentiality
Client information will be kept confidential and not shared with third parties, except as required by law or for promotional purposes outlined in Section 5.
9. Governing Law
These Terms are governed by the laws of NYS. Any disputes shall be resolved in Albany County NY.
10. Agreement
By booking services with Ryan Adams Videographer & Photographer, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
