Entity: Vivé Texas Homes, LLC (“Vivé Texas Homes,” “we,” “us,” “our”)

These Terms of Service (“Terms”) govern your use of our website and any interactions you initiate through it, including inquiries, consultations, and messaging. By using the site, you agree to these Terms and our Privacy Policy.

If you later enter a separate Construction Agreement with us, that agreement controls for your project. These Terms govern website use and pre-contract interactions only.

1. Use of the Site

- You must be 18+ and use the site for lawful purposes.

- Do not attempt to disrupt the site, scrape data, or impersonate others.

- Content on the site is for general information and marketing; it is not a binding offer, quote, or professional advice.

2. Intellectual Property

All site content (text, images, logos, videos, designs) is owned by Vivé Texas Homes or licensors and protected by law. You may not copy, distribute, modify, or create derivative works without written permission.

3. Consultations & Pre-Construction

Submitting a form (e.g., Book My Consultation, Start My Plan) is an inquiry, not a commitment by either party. Access and scheduling are subject to availability.

Non-binding estimates. Budgets, allowances, and timelines communicated before a signed Construction Agreement are estimates only and may change due to plans, selections, site conditions, permits, and market factors.

No start without contract. We will not order materials, commence construction, or hold a schedule without a fully executed Construction Agreement and required deposits.

4. Communications

By selecting consent on our forms:

- Transactional: You agree to receive operational emails/texts (appointments, confirmations, updates). Msg & data rates may apply. Reply STOP to opt out; HELP for help.

- Marketing (Optional): If opted in, you agree to promotional emails/texts. Msg & data rates may apply. Reply STOP to opt out; HELP for help.

5. Portfolio, Testimonials & Media

With your permission, we may document projects for portfolio and marketing. Testimonials reflect individual experiences and are not guarantees.

6. Third-Party Services & Links

We may reference or link to lenders, designers, inspectors, or other vendors. We do not control and aren’t responsible for their services or content.

7. Disclaimers

- The site is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

- We do not guarantee uninterrupted or error-free operation or that the site is free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by law, Vivé Texas Homes and its owners, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to site use or reliance on site content. Our total liability for any site-related claims will not exceed $100.

Nothing here limits your rights or our obligations under a duly executed Construction Agreement.

9. Indemnification

You agree to indemnify, defend, and hold harmless Vivé Texas Homes from claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site, violation of these Terms, or infringement of third-party rights.

10. Privacy

Our data practices are described in our Privacy Policy. By using the site or submitting forms, you consent to those practices.

11. Changes to the Site or Terms

We may update content or these Terms at any time. Updates are effective when posted. Continued use means you accept changes.

12. Governing Law & Venue

These Terms are governed by the laws of the State of Texas. Venue for site-related disputes lies in the state or federal courts in [Preferred County], Texas.

13. Miscellaneous
