1. Acceptance of Terms

By accessing or using LashFlow Systems ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our platform.

These terms apply to all users of the platform, including lash artists, studio owners, and administrators.

2. Description of Service

LashFlow Systems provides an all-in-one booking, marketing, and client management platform for lash artists. Our services include:

• Online booking calendar and appointment management
• Automated client reminders via SMS and email
• Client lash history tracking and profiles
• Payment processing and deposit collection via Stripe
• AI-powered chat assistant for client communication
• Marketing automation and review management tools
• LashFind directory listing and featured placement

3. Account Registration

To use LashFlow Systems, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and update your account information to keep it accurate.
• Keep your password secure and not share it with others.
• Be responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

4. Subscription Plans & Billing

LashFlow Systems offers three subscription tiers: Basic ($49/mo), Pro ($99/mo), and Elite ($149/mo). Annual plans are also available at a discounted rate.

• Billing: Subscriptions are billed monthly or annually in advance.
• Cancellation: You may cancel at any time. Access continues until the end of your current billing period.
• Refunds: We do not offer refunds for partial months. Annual plan refunds are considered on a case-by-case basis.
• Price Changes: We will notify you at least 30 days before any price changes take effect.
• Failed Payments: If payment fails, we will attempt to retry. After 3 failed attempts, your account may be suspended.

5. Acceptable Use

You agree not to use LashFlow Systems to:

• Violate any applicable laws or regulations.
• Send spam or unsolicited communications to clients.
• Collect or store personal data without appropriate consent from your clients.
• Impersonate any person or entity.
• Attempt to gain unauthorized access to our systems or other accounts.
• Use the platform for any purpose other than legitimate business operations.

6. Client Data Responsibilities

As a lash artist using LashFlow, you are responsible for the client data you store on our platform. You agree to:

• Obtain proper consent from clients before storing their personal information.
• Comply with applicable data protection laws (including GDPR if applicable).
• Not use client data for purposes other than managing your business.
• Maintain accurate and up-to-date client records.

7. Payment Processing

Payment processing is handled by Stripe. By using payment features, you also agree to Stripe's Terms of Service. LashFlow Systems is not responsible for payment disputes between you and your clients. Deposit collection and refund policies for your clients are your responsibility to communicate and enforce.

8. LashFind Directory

Your LashFind directory listing is subject to the following:

• All information must be accurate and not misleading.
• Featured placement is included with Pro and Elite plans and may be removed if you downgrade.
• We reserve the right to remove listings that violate our policies.

9. Intellectual Property

LashFlow Systems and its original content, features, and functionality are owned by LashFlow and are protected by intellectual property laws. You retain ownership of any content you create or upload to the platform.

By uploading content, you grant LashFlow a non-exclusive license to use it solely for providing our services to you.

10. Limitation of Liability

LashFlow Systems is provided "as is." We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost revenue, lost clients, or data loss. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, third-party services, or circumstances beyond our control. We will provide advance notice of scheduled maintenance where possible.

12. Termination

We may suspend or terminate your account if you violate these Terms of Service. You may cancel your account at any time from your account settings. Upon termination, your data will be retained for 90 days before permanent deletion.

13. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the platform after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
