These Terms of Use (“Terms”) govern your access to and use of all websites, digital products, online programs, classes, services, and content provided by The Cultivate Code, LLC, located at 9205 W Russell Rd, Building 3, Ste 240, Las Vegas, Nevada 89148 (“The Cultivate Code,” “we,” “our,” or “us”).
By accessing or using any of our websites, programs, or services (“Services”), you agree to be legally bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be:
18 years or older, or
16–17 years old with verified parental consent to participate in any program, coaching, or class.
2. Programs, Digital Products & Access
The Services include, but are not limited to:
Dance training programs
Fast Track, Sideline Ready, Sideline Sprint, The Prep Year
Audition preparation and coaching
Workshops, masterclasses, choreography classes
Live, virtual, and prerecorded dance/strength/conditioning classes
Templates, e-books, digital downloads
Slack community access
Email-based coaching or support
You receive a non-transferable, limited, revocable license to access content for personal use only.
You may not:
Share login credentials
Distribute or sell any program material
Reproduce choreography or content for commercial use
Teach, coach, or train others using our methods without written consent
Record, screen share, download, or redistribute protected materials
Violating these rules may result in immediate removal without refund.
3. Community Conduct (Slack, email, social features)
You agree not to:
Engage in harassment, hate speech, or disruptive behavior
Solicit, poach, or recruit other members
Share inappropriate or confidential information
Use our communities for self-promotion or sales
Upload or distribute viruses or harmful code
Scrape or extract data, including using AI tools to copy materials
We may remove any participant at our discretion for violations—without refund.
4. Non-Medical & Non-Legal Nature of Services
The Cultivate Code is not a medical, legal, or financial provider.
Nothing we provide should be construed as medical, psychological, therapeutic, or legal advice.
Always consult your physician before participating in physical dance training.
5. Payments & Billing
All payments are processed through third-party providers including:
Stripe
PayPal
Affirm
AfterPay
GoHighLevel Payments
When you enroll, you authorize us to charge your chosen payment method for the full order amount or all scheduled installment payments.

6. Termination
We may terminate your access for:
Breaching these Terms
Abuse of community or instructors
Unauthorized content sharing
Failed or disputed payments
No refunds will be issued upon termination for misconduct.
7. Intellectual Property Rights
All programs, choreography, videos, frameworks, templates, scripts, branding, and training systems are owned by The Cultivate Code, LLC.
You may not copy, reproduce, resell, modify, or create derivative works from any materials.
All rights are reserved.
8. Disclaimer of Warranties
We provide the Services “as is” with no guarantees.
We make no guarantees of:
Dance team placement
Audition results
Performance outcomes
Skill level advancement
Earnings or opportunities
Your success is your responsibility.
9. Limitation of Liability
To the maximum extent permitted by law, The Cultivate Code is not liable for:
Injuries arising from participation in dance or fitness programs
Technical issues or downtime
Loss of data
Third-party system failures
Emotional distress
Any indirect, incidental, or consequential damages
10. Arbitration & Governing Law
These Terms are governed by the laws of the State of Nevada.
All disputes will be resolved exclusively through binding arbitration in Clark County, Nevada.
No class actions may be filed.

2. REFUND & PAYMENT POLICY

The following policy applies to all digital products, programs, classes, and coaching offered by The Cultivate Code, LLC.
1. No Refunds
All sales are final.
We do not offer refunds under any circumstances, including but not limited to:
Change of mind
Scheduling conflicts
Failure to use or complete the program
Dissatisfaction with progress
Personal issues or time commitments
You are responsible for the full purchase amount.
2. Non-Cancellable Payment Plans
Payment plans are not subscriptions.
They are financial commitments to pay the full contract amount, divided into installments.
Payment plans cannot be canceled once agreed to.
3. Payment Failures & Default
If a payment fails:
We will attempt to charge your payment method 3 times.
If still unsuccessful, the remaining balance becomes immediately due in full.
Failure to pay may result in: Removal from programs Revocation of access Collections action
4. Accepted Payment Methods
We accept:

Affirm
AfterPay
GoHighLevel payment processing
5. Chargebacks & Disputes
Chargebacks or payment disputes constitute a breach of this agreement.
We reserve the right to:
Immediately remove your access
Send the unpaid balance to collections
Pursue legal or arbitration remedies

5. AFFILIATE PROGRAM TERMS

These terms govern participation in The Cultivate Code Affiliate Program.
1. Program Overview
Affiliates earn commissions for referring customers using their unique tracking link.
Commission rates, payout thresholds, and structures are defined during onboarding and may evolve as the program grows.
2. Prohibited Affiliate Conduct
Affiliates may NOT:
Make false or misleading claims
Promise guaranteed results
Use The Cultivate Code brand name in paid ads
Pretend to be the brand
Provide discounted/unauthorized coupon codes
Spam links
Misrepresent program content
Violation may result in removal and forfeiture of commissions.
3. Payouts
Paid via Stripe or PayPal
W9 required for U.S. affiliates
Minimum payout threshold applies
Fraudulent or refunded transactions are not commissionable
6. LIABILITY WAIVER & ASSUMPTION OF RISK
By participating in any dance, fitness, conditioning, or physical training offered by The Cultivate Code, LLC, you acknowledge and agree to the following:
1. Voluntary Participation
You voluntarily participate in:
Dance classes (in-person or virtual)
Strength and conditioning sessions
Flexibility and technique sessions
Choreography instruction
Pre-recorded or live training
2. Medical Disclaimer
The Cultivate Code and its instructors:
Are not medical professionals
Do not diagnose or treat injuries
Do not provide medical advice
Always consult your physician before beginning any fitness or dance program.
3. Assumption of Risk
You understand and accept all physical risks, including:
Muscle strain
Sprains or tears
Joint injuries
Cardiovascular issues
Falls
Overexertion
You release The Cultivate Code, its owners, instructors, assistants, and contractors from all liability for injuries.
4. Waiver of Claims
You waive any right to sue for:
Injuries
Damages
Accidents
Loss of property
This includes negligence claims to the fullest extent allowed by law.
5. Third-Party Instructors
The waiver applies to all instructors teaching under or on behalf of The Cultivate Code.
7. COMMUNITY GUIDELINES
Members must:
Treat others with respect
Follow instructor directions
Avoid hate speech or discrimination
Not poach clients or members
Not share or resell program materials
Not record sessions or distribute videos
Not use AI or software to extract content
Keep conversations confidential
Follow Slack and email etiquette
Violation may result in immediate removal without refund.

Team placement
Audition outcomes
Skill advancement
Performance improvements
Results vary.
