These Terms of Service (“Terms”) govern your use of the “Submit Your Deal” form (the “Form”) provided by WEEM Capital (“WEEM Capital”, “we”, “us”, or “our”) on our website. By completing and submitting the Form, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not submit the Form.
1. Purpose of the Form
The Form is provided solely to allow real estate investors, operators, and related entities to submit information about potential real estate deals for preliminary review.
- Submitting the Form allows WEEM Capital to review your deal and determine whether it may be suitable for potential funding or further discussion.
- Any reference to a “preliminary review within 24 hours” is an internal goal and not a guarantee of timing or outcome.
Submission of the Form does not:
- Create any obligation for WEEM Capital to provide funding, issue a term sheet, or enter into any agreement with you.
- Create a broker–client, lender–borrower, advisory, or fiduciary relationship.
2. Eligibility
By submitting the Form, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction).
- You have the legal capacity and authority to submit the deal information and enter into these Terms on your own behalf and/or on behalf of the entity you represent.
- You are submitting information for a legitimate business purpose related to real estate investing.
If you do not meet these requirements, you are not permitted to use the Form.
3. Information You Provide
By using the Form, you will be asked to provide certain information, which may include (but is not limited to):
- Full Name
- Phone
- Property Address
- City/State
- Deal Type
- Purchase Price
- Estimated Rehab Budget
- After Repair Value (ARV)
- Requested Loan Amount
- When You Need Funding
- Exit Strategy
- Your Experience Level
- Source (REIA / LinkedIn / Referral / QR Code / Other)
- Entity Name (if applicable)
- Additional Details / Questions
- Uploaded Documents (e.g., photos, scopes of work, budgets, financials, etc.)
You agree that:
- All information you provide is truthful, accurate, and complete to the best of your knowledge.
- You will not misrepresent your identity, experience, or any details about the property or deal.
- You have the right and authority to provide any data or documents you upload, and doing so does not violate the rights of any third party or any applicable law.
WEEM Capital may rely on the information you submit in evaluating your deal and may request additional information or documentation.
4. Use of Your Deal Information
By submitting the Form, you grant WEEM Capital the right to:
- Review, analyze, and underwrite your deal for potential funding opportunities.
- Share your deal information and documents with internal team members and, where appropriate, with third-party capital partners, private lenders, or investors who may participate in funding your deal.
- Use the “Source” field (REIA/LinkedIn/Referral/QR Code/etc.) for internal tracking, marketing analytics, and attribution.
Your information will be handled in accordance with our Privacy Policy, which describes how we collect, use, and protect personal data.
5. No Guarantee of Approval or Funding
You understand and agree that:
- Submission of the Form does not guarantee approval, funding, or a specific set of terms.
- Any verbal or written indication of interest, including a “preliminary review” or “potential fit,” is not a binding commitment to lend.
- Any future funding or engagement will be subject to separate written agreements, underwriting, due diligence, valuation, and other conditions determined by WEEM Capital and/or its partners.
You should not rely on the Form or any preliminary communication as a promise of financing.
6. Communications Consent (SMS, Email, Phone)
The Form includes two separate consent options for communications:
a. Transactional Messages (Required for Service-Related Updates)
By checking the transactional consent box and submitting the Form, you consent to receive transactional communications from WEEM Capital related to your submission, which may include:
- Deal submission confirmations and status updates
- Requests for additional information or documentation
- Appointment, call, or meeting confirmations and reminders
- Other service-related messages about your deal or account
These may be sent via SMS, email, and/or phone calls using the contact information you provide.
Message frequency may vary. Message & data rates may apply.
You may reply HELP for help or STOP to opt out of SMS messages.
Even if you opt out of SMS, we may still contact you via email or phone for transactional purposes where permitted by law.
b. Marketing Messages
By checking the marketing consent box, you consent to receive marketing and promotional messages from WEEM Capital, which may include:-
- Special offers and promotions
- Educational content related to real estate investing and funding
- Announcements of new products, services, or events
Message frequency may vary. Message & data rates may apply.
You may reply HELP for help or STOP to opt out of marketing SMS messages at any time.
Your consent to receive marketing messages is optional and is not a condition of submitting the Form, receiving services, or being considered for funding.
7. No Professional Advice
Any information communicated to you by WEEM Capital, whether via the Form, website, email, SMS, or phone, is for informational purposes only and does not constitute:
- Legal advice
- Tax advice
- Financial or investment advice
You are solely responsible for consulting your own professional advisors (attorney, accountant, financial advisor, etc.) before making any decisions related to real estate transactions, financing, or investments.
8. Intellectual Property
The Form, and any content, text, graphics, logos, or other materials displayed around it on our website, are owned by or licensed to WEEM Capital and are protected by applicable intellectual property laws.
You may not:
- Copy, reproduce, modify, distribute, or create derivative works based on the Form or website content, except as necessary to use the Form as intended.
- Use any WEEM Capital trademarks, logos, or branding without our prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law:
- WEEM Capital and its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Form or reliance on any information provided.
- WEEM Capital shall not be liable for loss of profits, business, data, or opportunities, even if advised of the possibility of such damages.
Your sole and exclusive remedy for dissatisfaction with the Form or these Terms is to discontinue use of the Form.
10. Indemnification
You agree to indemnify, defend, and hold harmless WEEM Capital and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Form;
- Your breach of these Terms;
- Your violation of any applicable law or third-party rights; or
- Any inaccurate or incomplete information you provide through the Form or in follow-up communications.
11. Governing Law & Dispute Resolution
These Terms, and any dispute arising out of or relating to them or your use of the Form, shall be governed by and construed in accordance with the laws of Florida, without regard to conflict-of-law principles.
You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Florida, and you hereby consent to the personal jurisdiction of such courts.
12. Electronic Records & Signatures
By completing and submitting the Form, you consent to the use of electronic records, electronic communications, and electronic signatures in connection with your inquiry and any related transactions, to the extent permitted by law.
13. Changes to These Terms
WEEM Capital may update or modify these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page.
Your continued use of the Form after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Form.
