Trademark protection may be based on common law or registration. In either case, trademark protection is based on the goods or services with which the mark is used in commerce.

A trademark may be associated with one type of good or service, or multiple types of goods and/or services. For example, a trademark may be associated with clothing (or a specific style of clothing), which is a particular type of good. The same trademark may also be associated with clothing retail services, which is a particular type of service to sell clothing. (Trademarks associated with services are often referred to as service marks.) As such, the trademark of this example may be used to identify goods in the form of clothing and services in the form of clothing retail services.
