Terms of Service for Redneck Painting LLC

These Terms of Service ("Terms") govern your access to and use of the services provided by Redneck Painting LLC ("we," "us," or "our"), including any communications you receive from us by SMS text message. By accessing or using our services, by submitting your contact information through our website or opt-in form, or by opting in to our SMS program, you agree to be bound by these Terms.
1. Services Provided
Redneck Painting LLC provides interior and exterior residential painting and home improvement services to homeowners in our service area. Services provided are those agreed upon in a signed contract or work order between Redneck Painting LLC and the Client. Any additional services requested in the future are optional and may incur additional fees, subject to the Client's written agreement.
2. SMS Communications and Use Cases
By providing your mobile phone number and opting in through our website opt-in form (or by providing written consent in another form), you expressly consent to receive recurring SMS text messages from Redneck Painting LLC. These messages may include:
Appointment reminders and confirmations
Follow-up messages related to quote requests, leads, and scheduling
Service updates and project status notifications
Occasional promotional offers and seasonal service reminders
Customer support communications
Consent to receive SMS messages is not a condition of purchasing any goods or services from Redneck Painting LLC.
Message Frequency. Message frequency may vary; you may receive up to approximately 5 messages per month based on your activity and project status.
Message and Data Rates. Standard message and data rates from your wireless carrier may apply to all SMS messages sent and received. Redneck Painting LLC is not responsible for any charges from your wireless provider.
Opt-Out Instructions. You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message, and no further SMS messages will be sent unless you re-subscribe. You may also contact us directly using the information in the "Contact Us" section to request removal.
Help and Support. For help or assistance with our SMS program, reply HELP to any message, or contact us directly using the information in the "Contact Us" section below.
Carrier Liability Disclaimer. Redneck Painting LLC and mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and network availability. Neither Redneck Painting LLC nor any wireless carrier shall be held responsible for any loss, injury, or damages resulting from SMS messages sent or received.
3. Privacy Policy and SMS Data Handling
Your privacy is important to us. Information collected through our SMS program and services is handled in accordance with our Privacy Policy, which describes how we collect, use, store, and protect your personal information, including your mobile phone number.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers, SMS opt-in data, or consent records collected through our SMS program.

4. Age Restriction
You must be at least 18 years of age to use our services or to consent to receiving SMS communications from Redneck Painting LLC. By agreeing to these Terms, you confirm that you are 18 years of age or older.
5. Client Responsibilities
The Client agrees to provide accurate contact information, reasonable access to the property for the work to be performed, and timely payment for services rendered in accordance with the agreed-upon contract or work order. The Client is responsible for clearing the work area of personal items and notifying Redneck Painting LLC of any property conditions, hazards, restrictions, or special considerations that may affect the work.
6. Payment Terms
Payment terms, including deposit requirements, payment schedule, and final payment due dates, are established in the signed contract or work order between Redneck Painting LLC and the Client. Late payments may be subject to fees as specified in the contract.
7. Limitation of Liability
To the fullest extent permitted by law, Redneck Painting LLC's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by the Client for the specific service giving rise to the claim. Redneck Painting LLC is not liable for indirect, incidental, consequential, or punitive damages.
8. Dispute Resolution and Arbitration
Any dispute arising under these Terms will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association, located in Boise, Idaho, and conducted in the English language. Each party shall bear its own costs and attorneys' fees, except where the arbitrator determines otherwise.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict-of-law principles.
10. Modifications
Redneck Painting LLC reserves the right to modify these Terms at any time. The "Effective Date" at the top will be updated whenever material changes are made. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
