LIVE VIRTUAL EVENT TERMS :

The following Terms and Conditions govern the agreement (“Agreement”) between You (the purchaser of the Live Virtual Breathwork Detox Event Offer (the “Offer”)) and Breathwork Detox, Inc., and its affiliates, sub-contractors, employees, agents, owners, or assigns (“Breathwork Detox”), attached hereto and entered into effective as of the date of Your purchase of the “Offer” (“Effective Date”). You and Breathwork Detox are each referred to as a “Party” and collectively as the “Parties.”

1. INTRODUCTION

Welcome to our Breathwork Detox Live Virtual Event. By registering for and participating in this event, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

2. ELIGIBILITY

  • Participants must be 16 years or older. If you are under the age of 16, you must receive parental consent to participate and your parent must be in the room with you during the event.
  • Participants must provide accurate, current, and complete information during registration.
  • You have read and understood the Waiver and Release of Liability at checkout of the Offer

3. EVENT DETAILS

  • The event will be conducted live via Zoom
  • The event date and time were provided to you upon registration at the check-out page and sent to you via email.
  • Participants will receive a link to join the event 24 hours prior to the event

4. HEALTH DISCLAIMER

  • Breathwork can be physically and emotionally demanding. Participants should consult their healthcare provider before participating.
  • By participating, you acknowledge that you are responsible for your own health and well-being during the event.

5. PARTICIPATION REQUIREMENTS

  • Ensure a stable internet connection and a suitable device for accessing the virtual event.
  • Find a quiet, comfortable space to participate without interruptions.
  • ​Follow the instructions provided by the event facilitator.

6. CODE OF CONDUCT

  • Respectful and appropriate behavior is expected from all participants.
  • Harassment, discrimination, or inappropriate conduct will not be tolerated and may result in removal from the event without a refund.

7. PRIVACY AND DATA PROTECTION

  • Your personal information will be collected and used in accordance with our Privacy Policy.
  • The event may be recorded for quality and promotional purposes. By participating, you consent to being recorded.

8. INTELLECTUAL PROPERTY

  • All materials provided during the event are the property of the event organizers and are protected by intellectual property laws.
  • Participants may not reproduce, distribute, or create derivative works from the event materials without written permission.

9. PAYMENTS AND REFUNDS

  • Payment must be completed at the time of registration.
  • Refunds are not available, except in the case of event cancellation by the organizers.

10. LIMITATION OF LIABILITY

  • The organizers are not liable for any injuries, losses, or damages that may occur during or as a result of participating in the event.
  • The event is provided on an "as-is" basis without warranties of any kind, either express or implied.

11. CANCELLATION AND CHANGES

  • The organizers reserve the right to cancel or reschedule the event due to unforeseen circumstances. Participants will be notified as soon as possible and offered alternative arrangements or a refund.
  • Changes to the event details will be communicated to participants in a timely manner.

12. CONTACTS

By signing the Agreement and providing Your credit card information, You agree that Breathwork Detox may call and text You regarding Your account information and regarding other offers, products, and services, and that this consent is not a condition of purchase.

13. GOVERNING LAW

  • These terms and conditions are governed by and construed in accordance with the laws of the state of Nevada.
  • Changes to the event details will be communicated to participants in a timely manner.

14. INDEMNITY

You agree to protect, defend, indemnify and hold harmless Breathwork Detox, its officers, directors, employees or their invitees, from and against all claims, demands, and causes of action of every kind and character without limit arising out of Your receipt of services or actions taken in response thereto. Your indemnity obligation includes, but is not limited to, any claim for personal injury sustained while traveling to or attending any seminar or other in-person training provided by Breathwork Detox to You.

15. LIMITATION OF LIABILITY

YOU AGREE THAT IN NO EVENT SHALL BREATHWORK DETOX’S LIABILITY TO YOU FOR ANY CLAIM OF ANY KIND OR DESCRIPTION EXCEED THE AMOUNT PAID BY YOU TO BREATHWORK DETOX IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO ANY CLAIM BY YOU. YOU WAIVE ANY RIGHT TO SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND OR DESCRIPTION.

16. FORCE MAJEURE

Except for the duty to make payments hereunder when due, and the indemnification provisions under this Agreement, neither Party shall be responsible to the other for any delay, damage, or failure caused by or occasioned by any act of God, act of nature or the elements, terrorism, insurrection, or any other causes (except financial) beyond the control of either Party.

17. ARBITRATION

Any claim or grievance of any kind, nature or description that You have against Breathwork Detox shall be resolved exclusively in final and binding arbitration before a single arbitrator selected by Breathwork Detox within a reasonable time of You giving notice of arbitration to Breathwork Detox Arbitration shall be held in Las Vegas, Nevada. You agree not to file suit in any court against Breathwork Detox, any of its affiliates, subsidiaries, officers, directors, or employees. The arbitration will be subject to the rules of the American Arbitration Association and the Federal Arbitration Act, 9 U.S.C. §§ 1-16 (“FAA”). The arbitrator shall have the exclusive and sole authority to determine whether any dispute is arbitrable. The decision of the Arbitrator will be final and binding on the Parties, subject to appeal only under the FAA, and may be reduced to a judgment in any court of competent jurisdiction. You agree that each Party shall bear its own costs and attorney’s fees in any arbitration or litigation, regardless of which Party, if either of them, is deemed the prevailing party. Any claim must be brought in arbitration within one (1) year of the claim arising or forever be barred. This agreement to arbitrate survives any termination or expiration of the Agreement as well as bankruptcy or insolvency of either Party. Nothing in these Terms and Conditions prevents Breathwork Detox from applying to and obtaining from any court having jurisdiction a temporary injunction, preliminary injunction, permanent injunction, or other relief available to protect Breathwork Detox’s interest prior to, during, or following the filing of any arbitration or other proceeding.
