
1. Eligibility & Selection
This promotion is limited to one selected property.
KC Legacy Properties reserves the right to select the property at its sole discretion based on need, safety, feasibility, and marketing suitability.
The property must be located within KC Legacy Properties’ service area.
2. Listing Requirement
To qualify for the complimentary clean-out service, the homeowner must sign a listing agreement with KC Legacy Properties prior to the clean-out.
The listing agreement must be fully executed before any clean-out services begin.
3. Pricing Agreement & Market Value
The homeowner agrees to list the property at a price recommended by KC Legacy Properties.
The recommended list price will be determined using:
Comparable sales in the area (comps)
Current market conditions
The condition of the property
A professional market analysis
The homeowner agrees to list the property at a price reasonably supported by market data.
If the homeowner refuses to list at a price supported by market analysis, KC Legacy Properties reserves the right to cancel the promotion prior to performing the clean-out.
4. Minimum Listing Period
The homeowner agrees to maintain the listing with KC Legacy Properties for the full term stated in the signed listing agreement.
The homeowner agrees to cooperate with reasonable showing requests and good-faith pricing strategy adjustments based on market feedback.
5. Cancellation & Breach
If the homeowner cancels, withdraws, or otherwise terminates the listing agreement at any time after the clean-out has been completed, the homeowner agrees to reimburse KC Legacy Properties for the full cost of the clean-out services.
If the homeowner materially interferes with the sale process or refuses to cooperate in good faith, this will be considered a breach of agreement.
6. Reimbursement & Contractor Lien
Prior to the clean-out, the homeowner will receive written disclosure of the estimated value of the clean-out services.
If reimbursement is required due to cancellation or breach, payment must be made within the agreed timeframe.
If payment is not made, KC Legacy Properties reserves the right to pursue all legal remedies available, including filing a contractor’s lien against the property where permitted by law.
7. Scope of Clean-Out Services
This promotion includes a full debris and contents removal service.
All contents inside the property will be discarded.
Items will not be:
Sorted
Appraised
Donated
Sold
Stored
If the homeowner wishes to conduct an estate sale, retrieve valuables, or explore liquidation options, those services are not included in this promotion and must be arranged separately prior to clean-out.
8. Removal of Personal Items
The homeowner must remove any items they wish to keep prior to the scheduled clean-out date.
Once the clean-out begins, no items will be saved.
KC Legacy Properties and its vendors are not responsible for items left inside the property.
9. Access & Non-Interference
For safety and efficiency reasons, the homeowner may not be present inside the property during the clean-out process.
The homeowner must provide full access to the property and agrees not to interfere with the clean-out crew.
10. Property Condition Requirements
The property must be structurally sound and safe for entry.
Homes with severe structural failure, hazardous materials (including but not limited to biohazards, asbestos, chemical contamination), active infestations posing health risks, or condemned status may be disqualified at the sole discretion of KC Legacy Properties.
Utilities may be required to be active if necessary for safe work conditions.
11. Media & Marketing Consent
By participating in this promotion, the homeowner grants permission to KC Legacy Properties to photograph and video record the property before, during, and after the clean-out.
These materials may be used for marketing, advertising, and educational purposes without compensation.
12. No Guaranteed Sale
KC Legacy Properties does not guarantee that the property will sell within a specific timeframe or at a specific price. Market conditions and buyer activity may impact results.
13. Right to Withdraw
KC Legacy Properties reserves the right to withdraw from the promotion at any time prior to the clean-out if:
Property conditions were misrepresented
The property is deemed unsafe
There is disruptive or aggressive behavior
The homeowner fails to comply with these terms
14. No Cash Value
This promotion has no cash value and is non-transferable.
