BMC Fulfillment Policy
This Coaching Agreement (the “Agreement”) is made effective as of today (the “Effective Date”) between BMC Coaching and the Client (referred to as “Customer/Client”), and SC Coaching (referred to as “Service Provider”). The Customer/Client and Service Provider are sometimes individually called a “Party” and together the “Parties.”
WHEREAS, the Customer/Client has requested the Service Provider to deliver the BMC Coaching Program services for $297 per month for a minimum of six months, transitioning to a month-to-month basis thereafter, which the Service Provider has agreed to provide under this Agreement.
IN CONSIDERATION of the commitments of this agreement by both Parties, and other good and valuable considerations, the adequacy and receipt of which are acknowledged and intended to be legally binding, both Parties agree to the following:
1.BMC Coaching Services: Per the terms and conditions outlined in this Agreement, the Service Provider commits to delivering the Sean Crane Coaching Program to the Customer/Client for $297 monthly for a minimum six-month period, transitioning to month-to-month thereafter.
2.BMC Coaching Monthly Payments: All coaching fees are based on the BMC Coaching Program at a rate of $297 per month for a six-month minimum, then on a month-to-month basis.
Pay in Full for 6 Months: $1,485
Pay in Full for 12 Months: $2,997
FULFILLMENT POLICIES
Refund Policy: At Unstoppable 365, all sales of our products and services are final. We do not provide refunds for purchases, including training sessions, digital downloads, or other services. If you suspect a billing error or encounter an issue with any product or service, please contact our support team at info@beastmodecode.com. We will evaluate each case individually to decide if a credit or solution is appropriate.
Shipping or Delivery Policy: Unstoppable 365 mainly provides digital services, so shipping or delivery of physical products is not typically involved. Any downloadable materials or digital products will be accessible upon the completion of your purchase. For future physical products, if applicable, shipping costs and delivery times will be clearly communicated during checkout. If you experience issues with digital access or physical product delivery, please reach out to us at info@beastmodecode.com.
Return Policy and Process: Since we do not sell physical products, we do not have a return process in place. All sales of digital products and services, such as personal training sessions, downloads, and materials, are final and non-refundable. If you encounter technical issues accessing a purchased product or service, please contact our customer support at info@beastmodecode.com for assistance.
Cancellation Policy: You may cancel our services at any time, but cancellations will not result in refunds for any unused portion of the services or products purchased. To cancel or reschedule a personal training session, please notify us at least 24 hours in advance at info@beastmodecode.com to avoid being charged for the session. Unstoppable 365 reserves the right to cancel or modify services at any time, with any paid unused portion potentially credited back at our discretion.
CLIENT-COACH EXPECTATIONS AND GUIDELINES
Today, I am electing to join the BMC Coaching Program. I acknowledge that I am making payment according to the terms outlined in this agreement. If I have chosen a payment plan, I understand that it follows the agreed structure detailed above for the BMC Coaching Program. I acknowledge that all sales are final with no refunds, the program is non-transferable, and this agreement becomes binding on the date signed, making me responsible for any payments per this agreement.
I understand that the coaching services and tools provided are designed to foster success, contingent on my active utilization of these tools, coaching, and guidance.
I acknowledge receiving access to the Coaching App, where all coaching program components, including habit and mindset, nutrition, fitness, and communication, will be delivered. I will receive Group Coaching Sessions, weekly feedback in various forms, and updated nutrition, fitness, and mindset coaching. I also have access to my coach through the Coaching Chat Group in the app, as well as entry into a Private Facebook Community.
I authorize BMC Coaching, the owning company of the BMC Coaching Program, to charge my Credit/Debit Card or bank account as per this Agreement. I agree that BMC Coaching may contact me via text, email, and phone for servicing and collection purposes, which could incur charges. If a payment fails due to insufficient funds or a credit card issue, I am responsible for back dues plus a $20 penalty for each failure. Access to coaching will be withheld until payments are resolved.
I understand that for the coaching program to be effective, I must remain open, honest, and communicative with my coach and be willing to engage in all areas essential for success, including Mindset, Habits, Nutrition, Fitness, and accountability. I am aware that my results ultimately depend on my effort, consistency, and dedication to the program.
ASSUMPTION OF RISK AND LIABILITY RELEASE
I acknowledge that by participating in the BMC Coaching Program, I am responsible for my own activities and dietary choices, and I understand that there are risks associated with any program. I recognize that all coaching guidance is advisory and it is my choice to follow or engage in the recommendations provided.
BMC Coaching assumes no responsibility for the outcomes of any program, regardless of who may have caused them. Risks can vary between activities and may range from minor to severe, including catastrophic injuries or death. In exchange for the benefits under this agreement, I voluntarily accept these risks and agree that BMC, its officers, directors, employees, volunteers, agents, and independent contractors will not be liable for injuries or damages of any kind to myself or others arising from their negligence or anyone associated with BMC, whether exercise-related or not.
As the undersigned participant, I acknowledge enrolling in a coaching program that may include physical activities such as walking, MMA workouts, cross training, weightlifting, sports drills, plyometric exercises, aerobic training, and contact sports training. I have been strongly advised to consult a physician before starting a new exercise program or increasing the intensity of an existing one, both in this documentation and by BMC Coaching. I take this responsibility upon myself and understand it is my decision to consult a physician before following recommendations. To my knowledge, there are no health conditions preventing me from participating in any BMC Coaching program, and I have not withheld pertinent information.
If deemed necessary by a physician, I have obtained a release to participate, which is acknowledged by BMC Coaching. I am not taking medications that may negatively impact my fitness activities, and relevant releases with or without restrictions have been provided. Should my health status change, I understand it is my responsibility to seek medical advice and have my coach modify my coaching program according to my physician's guidance.
I fully understand that I may sustain injuries from participating in BMC Coaching's program, and I hereby release BMC Coaching, its board, employees, and agents from any liability for injuries such as heart attacks, death, muscle strains, fractures, and other potential injuries, unless caused by trainer recklessness or intentional misconduct.
By participating in the BMC Coaching Program, I, on behalf of myself, my personal representatives, administrators, heirs, and assigns, hold harmless BMC Coaching, its board, employees, and agents from claims, demands, and actions, including legal and attorney fees, unless due to trainer recklessness or willful misconduct. I affirm that I have read, been candid with BMC Coaching, and fully understand the details above; I have had opportunities to ask questions and am prepared to participate.
You agree to indemnify, defend, and hold BMC Coaching harmless for liabilities caused by your negligence or other wrongful acts. You further agree to indemnify BMC Coaching against claims of bodily injury, wrongful death, or property damage incurred by you, your guests, or minors, even if BMC Coaching was negligent. Additionally, you acknowledge that BMC Coaching does not manufacture fitness equipment but acquires it. As BMC Coaching provides recreational health and fitness services, it cannot be held liable for equipment defects. I fully comprehend all aspects of this agreement and my commitments
