Terms and Conditions of Service

Please read these Terms and Conditions (“Terms”) carefully before using the https://blackmunlandmanagement.com/ website (“the Service”) and engaging Blackmun Land Management for any services (“the Contractor”). By accessing the Service, accepting a quote, or entering into any agreement for services, you (“the Client”) agree to be bound by these Terms.

1. Description of Services

Blackmun Land Management (CL#299115) provides professional land management services, including, but not limited to:

• Tree Removal, Trimming, and Pruning

• Stump Grinding

• Brush Clearing and Defensible Space Creation

• Land Clearing and Grading

• Other associated Land Management services.

The specific details, scope, and price of any service engagement are finalized only upon acceptance of a formal, written quote or execution of a separate Service Agreement between the Client and the Contractor.

2. Quotes, Acceptance, and Cancellation

2.1 Quote Validity: All quotes provided by the Contractor are valid for a period of thirty (30) days from the date of issuance. Pricing may be subject to revision after this period.

2.2 Acceptance: A quote is officially accepted upon written confirmation (including email or electronic signature) by the Client and, if required, payment of a specified deposit.

2.3 Cancellation: If the Client cancels the agreed-upon services less than 48 hours before the scheduled service date, the Client may be subject to a cancellation fee equivalent to 50% of the total contract price or a fixed fee to cover pre-mobilization costs.

3. Client Responsibilities and Site Conditions

3.1 Permits and Regulations: The Client is solely responsible for obtaining and paying for any required permits, neighborhood approvals, or municipal authorizations necessary for the completion of the work (e.g., tree removal permits), unless the Contractor explicitly agrees in writing to manage this process.

3.2 Utilities and Hazards: The Client must clearly identify and notify the Contractor of all known and unknown utilities, sprinkler lines, septic systems, drainage systems, or other underground or concealed hazards (including concrete, metal, or foreign objects within trees or soil) prior to the commencement of work.

3.3 Damage to Utilities: While the Contractor will exercise reasonable care, the Contractor is not liable for damage to unmarked or improperly marked underground facilities.

3.4 Site Clearance: The Client is responsible for relocating all personal property, vehicles, sensitive plants, or exterior decorations from the immediate work area prior to the crew’s arrival. The Contractor will exercise reasonable care but is not liable for incidental damage to items left within the work zone.

4. Unforeseen Conditions and Change Orders

4.1 Unforeseen Conditions: The Contractor is not responsible for unforeseen conditions that could not be reasonably discovered during the initial visual assessment, including, but not limited to: severe internal tree decay, hidden metal or foreign objects embedded in the tree, or unstable soil/rock conditions.

4.2 Change Orders: Should unforeseen conditions arise, or if the Client requests additional work outside of the original Scope of Work, the Contractor will immediately notify the Client. Any additional costs, services, or time required will be addressed via a written Change Order, which must be mutually agreed upon and signed before the additional work proceeds.

5. Limitation of Liability and Property Damage

5.1 Inherent Risks: The Client acknowledges that tree and land management work involves inherent risks. While the Contractor is licensed, bonded, and insured, and takes all reasonable precautions, minor impacts to surrounding areas (e.g., slight divots in lawn, tire marks on soft ground, wood chips/sawdust in garden beds) are normal and incidental to this type of work. The Contractor will not be liable for such minor impacts.

5.2 Clean Up: The Contractor agrees to remove and dispose of all debris generated by the service as defined in the Scope of Work. Stump grindings and wood chips resulting from work may be left on site unless explicitly contracted for removal.

5.3 Gross Negligence: The Contractor’s liability for property damage will be limited solely to damages caused by the direct gross negligence or willful misconduct of the Contractor’s personnel or equipment.

6. Payment Terms

Payment terms are as specified in the written Quote or Service Agreement. Full payment is due upon satisfactory completion of work and receipt of invoice.

7. Governing Law

These Terms and any resulting service agreement shall be governed by and construed in accordance with the laws of the State of California
