Welcome to Phoenix Island Charters. By booking a charter, using our website, or participating in any of our services, you agree to the Terms and Conditions below. Please read them carefully before making a reservation.
1. Company Information
Phoenix Island Charters provides private yacht charter experiences in the United States Virgin Islands.
Departure Locations Charters typically depart from:
Sapphire Marina (St. Thomas)
Cruz Bay (St. John)
Lovango Marina
Other pickup locations may be arranged when available.
2. Charter Services
Phoenix Island Charters offers private, fully customizable charters aboard a 37’ Axopar vessel AND Mainship Pilot 30' operated by a U.S. Coast Guard licensed captain.
Typical charter details:
Duration: 3.5–8 hours
Maximum group size: 11 guests
Stops for snorkeling, beaches, and sightseeing
Optional lunch stops at local restaurants (lunch cost not included)
Charter routes and destinations may change depending on weather, sea conditions, or the captain’s judgment for safety.
3. What’s Included
Most charters include:
U.S. Coast Guard licensed captain
Safety equipment exceeding USCG requirements
Snorkeling gear (mask, fins, sanitized snorkels)
Inflatable loungers
Bottled water
Cooler with ice (guests may bring beverages)
Bathroom facilities and shaded seating
Safety instruction for activities
Drone video (upon request and availability)
4. Guest Responsibilities
For everyone’s safety and enjoyment, guests must:
Follow all instructions from the captain or crew
Follow safety rules while onboard
Avoid unsafe or illegal behavior
Supervise children at all times
Phoenix Island Charters reserves the right to end a charter without refund if guest behavior puts safety at risk, violates laws, or damages the vessel.
5. What to Bring
Guests are encouraged to bring:
Towels
Bathing suits
Hats and sunglasses
Underwater camera
Reef-safe biodegradable sunscreen
Personal beverages (BYOB allowed)
Illegal substances are strictly prohibited.
6. Passenger Limit
The vessel can safely accommodate a maximum of 11 passengers in accordance with maritime regulations.
Phoenix Island Charters reserves the right to deny boarding if this limit is exceeded.
7. Booking and Payment
All reservations must be made in advance and are subject to availability.
A charter is considered confirmed once payment has been successfully processed. Payment terms may vary depending on the booking platform or agreement.
8. Cancellation Policy
Customers will receive:
Full refund or credit with at least 72 hours notice of cancellation
Full refund or credit if Phoenix Island Charters cancels due to weather or unforeseen circumstances
If a cancellation is made within 24 hours of the scheduled charter, no refund will be issued.
Charters operate rain or shine unless the captain determines conditions are unsafe.
If weather or safety conditions prevent the trip, Phoenix Island Charters may:
Reschedule the charter
Provide a credit
Issue a full refund
The captain’s safety decisions are final.
10. British Virgin Islands (BVI) Travel
Some charters may travel to the British Virgin Islands (BVI).
Guests should be aware:
Additional customs, immigration, and fuel fees may apply depending on the itinerary
All guests must have a valid passport
Visitors must complete immigration and customs clearance at an authorized port of entry
Guests are encouraged to upload passport information in advance to avoid delays.
Phoenix Island Charters is not responsible for denied entry due to missing or invalid travel documents.
11. Liability and Risk
Boating, snorkeling, swimming, and other water activities involve inherent risks.
By participating in a charter, guests acknowledge these risks and agree that Phoenix Island Charters, its owners, captains, and affiliates are not liable for:
Personal injury
Loss or damage of personal belongings
Accidents during normal charter activities
Guests are required to sign a liability waiver before boarding.
12. Damage to the Vessel
Guests are responsible for any damage caused to the vessel or equipment due to negligence, misconduct, or failure to follow instructions.
Repair or replacement costs may be charged to the responsible guest.
13. Photography and Media
Photos or videos may be taken during charters for marketing or promotional purposes.
By participating in a charter, guests allow Phoenix Island Charters to use these images unless a written request is made before the charter.
14. Itinerary Changes
The captain may adjust the charter itinerary at any time due to:
Weather conditions
Sea conditions
Safety concerns
Mechanical issues
Government or port authority regulations
15. Governing Law
These Terms and Conditions are governed by the laws of the United States Virgin Islands. Any disputes will be handled under the appropriate jurisdiction.
16. Changes to These Terms
Phoenix Island Charters may update these Terms and Conditions at any time. Updated versions will be posted on the website with a new effective date.
