Everyone needs to give consideration and be aware of the financial consequences if you die or lose capacity.
This is especially true as part of the Smart Separation Process and “drawing a line in the sand”. It is essential to draw up a new Will. Divorce revokes a Will but separation doesn’t.
If there is no Will, the rules of Intestacy provide who is to receive the estate (spouse, children, parents, siblings). This may not be in accordance with your wishes.
You may wish to enter into a Power of Attorney or Enduring Guardianship, appointing your most trusted person to handle your financial or personal affairs, if you lose capacity such as from dementia or stroke.
These issues are straightforward and should be discussed and we at Modern Family Law Solutions can help you can help you resolve them cheaply and effectively.
