Your Services: Wills, Powers of Attorney and Enduring Guardianship

  • Everyone needs to give consideration and be aware of the financial consequences if you die or lose capacity.

  • This is especially true as part of the Smart Separation Process and “drawing a line in the sand”. It is essential to draw up a new Will.  Divorce revokes a Will but separation doesn’t.

  • If there is no Will, the rules of Intestacy provide who is to receive the estate (spouse, children, parents, siblings).  This may not be in accordance with your wishes.

  • You may wish to enter into a Power of Attorney or Enduring Guardianship, appointing your most trusted person to handle your financial or personal affairs, if you lose capacity such as from  dementia or stroke.
