Conveyancing is the legal process required to transfer a property to a new owner.
We can provide a conveyancing service as part of the property settlement process. It is generally straightforward and not costly.
If it is part of a family law process following Consent Orders, a property is transferred from one party to the other party.
This can involve the discharge of a joint mortgage, with one party refinancing. Alternatively the parties may agree to sell the property together as part of the settlement and share the proceeds of sale.
If Conveyancing is necessary, we will discuss it with you as part of the Property Settlement process.
Book a free Initial Consultation by clicking the button below. We will provide an estimate of Costs in a new Mutual Commitments and Costs Agreement as to Conveyancing and generally a payment of $880 is required to start the process.
If it is a family law settlement by which a property is being transferred from one party to the other, we will do the necessary work including:
Onboarding you as a client.
Arranging the necessary verification of identities.
Do the title searches.
Arrange the transfer and discharge of mortgages.
Set up the PEXA (computerised conveyancing) workspace and
Invite in the other party and arrange the online settlement.
If it is a sale by the parties together of a property to a third person, it is a little more complicated and requires the drafting of an Agreement for Sale, arranging the exchange of contracts and setting up the settlement.
We prepare and lodge the necessary documents and calculate the settlement payments. We ensure funds are correctly transferred and title changes hands and the transfer is registered.
