1. Introduction

Welcome to Blissful Basics LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our esthetics services, website, and other offerings (collectively, the "Services"). Please read these Terms carefully. By accessing, using, or participating in the Services, you agree to be bound by these Terms.

2. Acceptance of Terms

2.1 Binding Agreement

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2.2 Eligibility

You must be at least 18 years of age to use our Services. By agreeing to these Terms, you represent and warrant that: (a) you are at least 18 years of age; (b) you have not previously been suspended or removed from the Services; and (c) your use of the Services does not violate any applicable law or regulation.

2.3 Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email notification, providing notice through the Services, or updating the "Effective Date" at the top of these Terms. Unless we say otherwise, amended Terms will be effective immediately and your continued use of the Services after the amended Terms are posted will constitute your agreement to the amended Terms.

3. Services and Appointments

3.1 Esthetics Services

We provide esthetics services including, but not limited to, facials, waxing, brow and lash services, and other skin care treatments. All services are performed by licensed estheticians in accordance with applicable laws and regulations.

3.2 Appointment Booking

You may book appointments through our website, by email, or in person. When booking an appointment, you agree to provide accurate, current, and complete information. You acknowledge that booking an appointment constitutes a commitment to pay for the scheduled services and to arrive at the scheduled time.

3.3 Cancellation Policy

We require 24 hours' notice for cancellation or rescheduling of appointments. Cancellations made with less than 24 hours' notice may result in a cancellation fee equal to 50% of the scheduled service price. No-shows will be charged the full service price. Repeated cancellations or no-shows may result in the requirement of a deposit for future appointments or the inability to book future appointments.

3.4 Late Arrivals

If you arrive late for your appointment, we will make every effort to accommodate you. However, depending on scheduling constraints, your service may need to be shortened or rescheduled. Full service fees apply regardless of shortened services due to late arrival.

4. Health and Safety

4.1 Health Information

You agree to complete any requested health intake forms completely and accurately. You are responsible for disclosing all relevant health information, including but not limited to allergies, skin conditions, medications, and medical treatments that may affect your esthetics services. Failure to disclose relevant health information may result in adverse outcomes for which we cannot be held responsible.

4.2 Right to Refuse Service

We reserve the right to refuse service to anyone if we believe that providing services might pose a health or safety risk to the client or our staff. This includes, but is not limited to, clients with contagious skin conditions, clients under the influence of drugs or alcohol, or clients who have not disclosed relevant health information.

4.3 Pregnancy and Medical Conditions

Certain services may be contraindicated during pregnancy or for clients with specific medical conditions. You agree to inform us if you are pregnant or have any medical conditions that may affect your treatment.

5. Payment Terms

5.1 Pricing

All prices for services are as listed on our website, service menu, or as quoted at the time of booking. We reserve the right to modify our prices at any time. Price changes will not affect appointments already confirmed.

5.2 Payment Methods

We accept various payment methods, including credit cards, debit cards, and cash. All payments are processed securely through our payment processors.

5.3 Gratuities

Gratuities are not included in the service price and are at your discretion. We appreciate your recognition of exceptional service.

5.4 Gift Cards

Gift cards are available for purchase and may be redeemed for services or products. Gift cards are not redeemable for cash, have no cash value, and expire one year from the date of purchase unless otherwise prohibited by law.

6. Product Purchases

6.1 Product Recommendations

Our estheticians may recommend skincare products based on your skin condition and treatment plan. While we make recommendations in good faith, we cannot guarantee specific results from the use of any products.

6.2 Returns and Exchanges

Unopened products in original packaging may be returned or exchanged within 14 days of purchase with the original receipt. Opened products cannot be returned unless defective. We do not offer refunds on services.

6.3 Product Use

You agree to use all products according to the instructions provided. We are not responsible for adverse reactions resulting from improper use or failure to follow instructions.

7. Intellectual Property

7.1 Ownership

All content, design, graphics, compilation, magnetic translation, digital conversion, and other materials included in the Services, and all intellectual property rights related thereto, are the property of Blissful Basics LLC or our licensors.

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and view the content on our website solely for your personal, non-commercial use.

7.3 Restrictions

You may not (a) copy, modify, or create derivative works of the Services or content; (b) distribute, publicly display or publicly perform the Services or content; (c) reverse engineer or decompile the Services; or (d) use the Services or content in any way not expressly permitted by these Terms.

8. Client Conduct

8.1 Prohibited Conduct

You agree not to engage in conduct that: (a) is unlawful, harassing, threatening, or disruptive; (b) infringes on the rights of others; (c) interferes with the operation of our spa; (d) creates a hostile environment for staff or other clients; or (e) involves solicitation of our staff or clients.

8.2 Respectful Environment

We strive to maintain a peaceful, respectful environment for all clients. Disruptive behavior, including loud conversations, cell phone use during services, or inappropriate remarks, may result in termination of services.

9. RevleNet Esthetics Management System

9.1 Client Records

We use RevleNet software to manage our esthetics business, including client records, appointment scheduling, service history, and billing information. By using our Services, you consent to your information being stored and processed in the RevleNet system.

9.2 Data Security

Your information in the RevleNet system is protected with industry-standard security measures. We do not share your information with RevleNet for marketing purposes.

9.3 System Availability

While we strive to maintain consistent access to your information through RevleNet, we cannot guarantee continuous availability of the system as this depends on the RevleNet platform.

10. Artificial Intelligence and Automated Systems

10.1 AI Use Disclosure

Blissful Basics LLC utilizes various artificial intelligence (AI) technologies, automated systems, chatbots, and voice recognition technologies to enhance our services, including but not limited to appointment scheduling, marketing communications, customer service, and business operations. By using our Services, you acknowledge and consent to interactions with these AI-powered systems.

10.2 AI-Generated Content

Certain content that you may encounter through our Services, including marketing materials, responses to inquiries, product descriptions, or communications, may be wholly or partially created or assisted by generative AI technologies. We review AI-generated content before sharing it with you, but we do not warrant that such content is entirely free from errors or inaccuracies.

10.3 Voice AI Interactions

When you interact with our voice-enabled AI systems:

• You consent to the recording and processing of your voice for the purpose of fulfilling your requests
• You understand that transcription may not be 100% accurate
• You acknowledge that background voices or sounds may be inadvertently captured
• You will be notified when interacting with an AI system rather than a human representative
• You may request human assistance at any time during the interaction

10.4 AI and Appointment Scheduling

Our AI-powered appointment scheduling system may suggest appointment times based on various factors, including your preferences, our availability, and service requirements. While we strive for accuracy, the final confirmation of any appointment is subject to human verification. You remain responsible for attending appointments you have confirmed, even if initially suggested by our AI system.

10.5 AI Recommendations

Our systems may use AI to make product or service recommendations based on your purchase history, service preferences, or information you provide. These recommendations are provided for informational purposes only and do not constitute professional medical or dermatological advice. We do not guarantee that recommended products or services will be suitable for your specific needs, and you should always consult with our human estheticians for personalized advice.

We are committed to transparency regarding AI use. All automated communications will be clearly identified as such, and we will distinguish between AI-generated content and content created by humans when such distinction is relevant to the service being provided.

10.8 No AI Medical Advice

Our AI systems do not provide medical advice, diagnosis, or treatment. Any skin care recommendations or information provided by our AI systems should be considered general information only and not a substitute for professional medical advice or treatment by a licensed esthetician, dermatologist, or healthcare provider.

10.9 AI Limitations and Liability

You acknowledge that AI technologies have inherent limitations and may occasionally provide inaccurate or incomplete information. To the maximum extent permitted by applicable law, Blissful Basics LLC disclaims all liability for any damages, losses, or harm arising from:

• Inaccuracies or errors in AI-generated content or recommendations
• Misunderstandings in voice recognition or natural language processing
• Technical failures of AI systems
• Decisions you make based on information provided by our AI systems
• Any unauthorized access to our AI systems

You agree that Blissful Basics LLC's maximum liability for any claim related to our AI systems shall not exceed the amount you paid for the specific service directly related to the claim.

10.10 AI Content Ownership

All content generated by our AI systems in response to your interactions is owned by Blissful Basics LLC. However, your personal information and any content you create or provide remains your property, subject to the licenses granted to us under these Terms and our Privacy Policy.

10.11 Human Oversight and Verification

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT.

11.2 Results Not Guaranteed

Esthetics services and skincare products affect individuals differently. We cannot guarantee specific results from any services or products. Results may vary.

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BLISSFUL BASICS LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11.4 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Blissful Basics LLC, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any principles of conflicts of law.

13.2 Arbitration

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Morris County, New Jersey, using the English language in accordance with the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.

13.3 Waiver of Class Actions

Any claims brought against Blissful Basics LLC must be brought in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

14. SMS/Text Messages

14.1 Opt-In Consent

If you opt in to receive SMS/text messages from us, you consent to receive text messages at the phone number provided.

14.2 Opting Out

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode (number provided). Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us.

14.3 Message and Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

14.4 Carriers

Carriers are not liable for delayed or undelivered messages.

15. Photographs and Social Media

15.1 Before and After Photos

We may request to take before and after photos of your treatments for our records and/or promotional purposes. Such photos will only be taken and used with your explicit written consent.

15.2 Social Media

If you share content about our services on social media and tag us or use our hashtags, you grant us permission to repost or share that content. If you wish to have your content removed from our social media, please contact us at meghan@blissfulbasics.com.

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Blissful Basics LLC regarding the use of the Services, superseding any prior agreements between you and Blissful Basics LLC relating to your use of the Services.

16.2 Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

16.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

16.4 Assignment

These Terms are not assignable, transferable, or sublicensable by you except with Blissful Basics LLC's prior written consent. Blissful Basics LLC may assign, transfer, or delegate any of its rights and obligations hereunder without consent.

16.5 Force Majeure

We will not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, acts of God, terrorist acts, natural disasters, pandemics, or government restrictions.
