ACX BUILD LLC (“ACX,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information that you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website at acx.ai (the “Site”), interact with our advertisements, contact us by phone, email, or text message, or otherwise engage with our products, services, marketing communications, and social media presence (collectively, the “Services”).

This Privacy Policy is designed to comply with applicable U.S. federal and state privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), the Connecticut Data Privacy Act (CTDPA), the Utah Consumer Privacy Act (UCPA), and other comparable state laws; the Children’s Online Privacy Protection Act (COPPA); the Telephone Consumer Protection Act (TCPA); the CAN-SPAM Act; and, where applicable, the EU and UK General Data Protection Regulation (GDPR). It also addresses our use of advertising and analytics platforms such as Meta (Facebook and Instagram), Google, TikTok, LinkedIn, and similar services.

2. Information We Collect

We collect several categories of information from and about users of our Services. The categories below describe the types of information we may collect.

2.1 Information You Provide Directly to Us

       Identifiers and Contact Information: Name, mailing address, email address, telephone number, and similar identifiers you provide when you fill out forms, request information, sign up for newsletters, schedule a consultation, or contact us.

       Account and Profile Information: Username, password, profile details, and preferences when you create an account.

       Commercial Information: Records of products or services purchased, obtained, or considered, billing and payment information (processed by our payment processors), and transaction history.

       Advertising and Analytics Partners: Meta (Facebook/Instagram), Google, TikTok, LinkedIn, and other ad platforms that share data about how you interact with our ads, including ad impressions, clicks, conversions, and audience information.

       Social Media Platforms: If you interact with us through social media (e.g., liking, commenting, messaging, or clicking on our ads), we may receive information from those platforms in accordance with their privacy policies and your privacy settings.

       Service Providers and Partners: Hosting providers, CRM systems, email marketing platforms, payment processors, analytics providers, and lead generation partners.

       Publicly Available Sources: Public databases, business directories, and similar sources.

3. How We Use Your Information

We use the information we collect for the following business and commercial purposes:

       Provide Services: Operate, maintain, and provide the Services; process transactions; fulfill requests; and provide customer support.

       Communicate with You: Respond to inquiries, send administrative messages, provide service-related information, and follow up on consultations or quotes.

       Marketing and Advertising: Send promotional emails, text messages, and other marketing communications (where permitted); deliver personalized advertising on the Site, on social media platforms (including Facebook, Instagram, TikTok, LinkedIn, and X), and across the web; measure ad effectiveness; and create custom and lookalike audiences.

       Phone and SMS Communications: Place outbound calls or send text messages to you in compliance with the TCPA, including informational messages, appointment reminders, and (with your prior express written consent where required) marketing messages.

       Analytics and Improvement: Understand how users interact with our Services, perform analytics, conduct research, develop new features, and improve our Services.

       Security and Fraud Prevention: Detect, prevent, and respond to fraud, unauthorized access, and other illegal activities; protect the rights, property, and safety of ACX, our users, and others.

       Legal Compliance: Comply with applicable laws, regulations, court orders, subpoenas, and other legal processes; enforce our terms and policies.

       Business Operations: Conduct internal business operations, including audits, financial reporting, and corporate transactions.

4. How We Share Your Information

We may share your information with the following categories of recipients:

       Service Providers: Third-party vendors who perform services on our behalf, such as website hosting, IT services, email delivery, payment processing, customer relationship management, analytics, marketing, advertising, and fraud prevention. These service providers are contractually required to use the information only as needed to perform their services.

       Advertising Partners: Platforms such as Meta (Facebook/Instagram), Google, TikTok, LinkedIn, and similar advertising networks. We may share or allow these partners to collect information directly through pixels, SDKs, and similar technologies to deliver targeted advertising and measure ad performance. Some of these data-sharing activities may be considered a “sale” or “sharing” of personal information under certain U.S. state laws (see Section 9).

       Business Partners: Trusted partners with whom we offer joint products, services, or promotions.

       Affiliates: Our parent, subsidiary, and affiliated entities, for purposes consistent with this Privacy Policy.

       Legal and Safety: Law enforcement, government agencies, courts, or other third parties when required by law, subpoena, or other legal process; or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others, investigate fraud, or respond to a government request.

       Business Transfers: In connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of all or a portion of our assets, or similar transaction. You will be notified of any such change in ownership or control of your personal information.

       With Your Consent: We may share information with other parties when you direct us to or otherwise consent.

We do not sell your personal information for monetary consideration. However, certain disclosures to advertising partners (such as the use of cookies and tracking pixels for cross-context behavioral advertising) may qualify as a “sale” or “sharing” under California, Colorado, Connecticut, and other state privacy laws. You have the right to opt out of these activities (see Section 9).

5. Facebook, Meta, and Social Media Advertising

We use advertising and analytics tools provided by Meta Platforms, Inc. (the operator of Facebook and Instagram), and may use similar tools from Google, TikTok, LinkedIn, X, Pinterest, Snap, and other platforms. Specifically:

       Meta Pixel and Conversions API: We use the Meta Pixel and/or Conversions API on our Site to measure the effectiveness of our advertising, understand visitor actions, and deliver relevant advertising. The Pixel collects information such as your IP address, browser/user-agent string, pixel ID, Facebook cookie, and information about your interactions with our Site (e.g., page views, button clicks, form submissions, and purchases).

       Custom Audiences: We may upload hashed contact information (such as email addresses or phone numbers) to Meta and other platforms to create Custom Audiences and reach you with relevant advertising. We may also use Lookalike/Similar Audiences to reach new users with characteristics similar to our existing customers.

       Retargeting: We use retargeting technologies to display ads to users who have previously visited our Site or interacted with our content.

       Conversion Tracking: We track conversions (e.g., leads, purchases, sign-ups) to measure ad performance and optimize our campaigns.

To opt out of Meta’s use of cookies and similar technologies for advertising, visit your Facebook ad preferences at facebook.com/adpreferences and your Instagram ad settings. To opt out of interest-based advertising more broadly, visit the Digital Advertising Alliance at optout.aboutads.info, the Network Advertising Initiative at optout.networkadvertising.org, or the European Interactive Digital Advertising Alliance at youronlinechoices.eu. On mobile devices, you can use your device settings to limit ad tracking (e.g., “Limit Ad Tracking” on iOS or “Opt out of Ads Personalization” on Android).

6. Phone Calls, Text Messages, and Email Communications

6.1 Phone Calls

If you provide us with your telephone number, you consent to receive calls from ACX BUILD LLC at that number, including calls relating to your inquiries, transactions, account, and (where you have provided the necessary prior express written consent under the TCPA) marketing or promotional calls. Calls may be made using an automatic telephone dialing system or prerecorded/artificial voice messages where permitted by law. Standard call rates from your carrier may apply. You may revoke consent for marketing calls at any time by contacting us using the information in Section 14.

6.2 Text Messages (SMS/MMS)

If you opt in to receive text messages from ACX, you agree to receive recurring automated text messages at the mobile number you provide. Message and data rates may apply. Message frequency varies. To stop receiving texts, reply STOP to any message. For help, reply HELP or contact us at [email protected]. We will not share your mobile opt-in or consent information with third parties for their marketing purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes (excluding subcontracted service providers operating on our behalf to deliver the messages).

6.3 Email Communications

We send commercial email in compliance with the CAN-SPAM Act. Every marketing email we send includes a clear and conspicuous unsubscribe link, our physical mailing address, and an honest subject line and “from” address. You may unsubscribe at any time by clicking the unsubscribe link in our emails or by emailing [email protected]. We will honor unsubscribe requests within 10 business days as required by law.

Please note that even if you opt out of marketing communications, we may continue to send you transactional or service-related communications (such as account notices, security alerts, and responses to your inquiries).

7. Cookies and Tracking Technologies

We and our third-party partners use cookies, web beacons, pixels, tags, SDKs, and similar technologies (collectively, “cookies”) to recognize you, remember your preferences, and understand how you use the Services. The categories of cookies we use include:

       Strictly Necessary Cookies: Required for the Site to function and cannot be disabled in our systems.

Most browsers do not currently respond to “Do Not Track” (DNT) signals in a uniform way, so we do not respond to DNT signals at this time. However, we honor opt-out preference signals such as the Global Privacy Control (GPC) where required by applicable law.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. The criteria used to determine our retention periods include the duration of our relationship with you, legal obligations to which we are subject (e.g., tax, accounting, or other legal requirements), the existence of any actual or anticipated legal claims, and applicable statutes of limitation.        Right to Opt Out of Sale/Sharing: Opt out of the “sale” or “sharing” of your personal information, including for cross-context behavioral advertising.

       Right to Limit Use of Sensitive Personal Information: Limit our use of certain sensitive personal information (where applicable).

       Right to Opt Out of Targeted Advertising and Profiling: Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.

       Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

9.2 California Shine the Light

9.3 Rights Under GDPR (EU/UK Residents)

11. Children’s Privacy

Our Services are not directed to, and we do not knowingly collect personal information from, children under the age of 13 (or the equivalent minimum age in the relevant jurisdiction). ACX BUILD LLC is based in the United States, and the information we collect is processed in the United States.
