1. Acceptance of Terms

By accessing and using the website homesforsalemorris.com (the "Site") and any services provided by Christy Schmaedeke, REALTOR® ("we," "us," "our," or "Company"), including but not limited to property search services, market reports, home valuations, SMS/text messaging programs, email communications, and real estate brokerage services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Use ("Terms").

If you do not agree to these Terms, please do not use the Site or Services.

These Terms constitute a legally binding agreement between you and Christy Schmaedeke, REALTOR®, operating as a licensed real estate agent with Keller Williams Infinity - Elevate Real Estate Team.

2. Use of the Site

Permitted Uses

You may use the Site for lawful purposes only, including:

Searching for properties for personal, non-commercial use
Contacting us regarding real estate services
Accessing market reports and property information
Creating an account to save property searches and preferences
Receiving communications you have opted into

Prohibited Uses

You agree not to:

Violate any applicable local, state, national, or international law or regulation
Post or transmit any content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
Engage in any conduct that restricts or inhibits any other user from using or enjoying the Site
Use any automated system, including "robots," "spiders," or "offline readers," to access the Site
Harvest or collect email addresses or other contact information from the Site
Use the Site for any commercial purpose without our prior written consent
Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site
Use MLS/IDX data for any purpose other than identifying properties you may be interested in purchasing
Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission

3. SMS/Text Messaging Terms of Service

Program Name and Description

Christy Schmaedeke Real Estate Alerts

By providing your mobile phone number and opting in to receive SMS/text messages from Christy Schmaedeke, REALTOR®, you agree to receive the following types of messages:

Property Alerts: Notifications about new listings matching your search criteria
Appointment Reminders: Confirmations and reminders for property showings and meetings
Transaction Updates: Time-sensitive information about your real estate transaction
Market Updates: Information about local real estate market conditions
Customer Service: Responses to your inquiries and support messages
Marketing Messages: Promotional messages about our real estate services (requires separate opt-in consent)

Consent Requirements

By opting in to our SMS program, you confirm that:

You are the owner or authorized user of the mobile device and phone number provided
You consent to receive SMS/text messages from Christy Schmaedeke, REALTOR® at the phone number provided
You understand that consent is not a condition of purchasing any property or services
You are at least 18 years of age

Message Frequency

Message frequency varies based on your activity and preferences. You may receive multiple messages per day during active transactions or when new properties match your criteria. Marketing messages are sent periodically, typically no more than 4 messages per month.

Opt-Out Instructions

You can cancel the SMS service at any time.

Simply text "STOP" to any message you receive from us. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us.

Alternative opt-out methods:

Reply "STOP," "UNSUBSCRIBE," "CANCEL," "END," or "QUIT" to any message
Email us at [email protected] with your phone number and request to opt out
Call us at (815) 693-5757 to request removal

Rejoining the Program

To rejoin our SMS program after opting out, sign up as you did initially through our website or contact us directly, and we will resume sending SMS messages to you.

Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless service provider/network operator. T-Mobile, AT&T, Verizon, and other carriers are not responsible for any delays, failures, or content of messages.

Message and Data Rates

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

Privacy and Information Sharing

Important: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services.

Major carriers supported include: AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and most regional carriers. Carriers are not responsible for message content.

Program Changes

We reserve the right to modify or terminate our text messaging services at any time, for any reason, without notice and without liability to you.

4. Account Registration

Creating an Account

To access certain features of the Site, such as saving property searches and receiving personalized alerts, you may need to create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, including:

Violation of these Terms
Extended inactivity
Fraudulent or illegal activity
At your request

5. Intellectual Property

Our Content

All content on the Site, including but not limited to text, graphics, logos, images, photographs, videos, software, and the compilation thereof, is the property of Christy Schmaedeke, Keller Williams Infinity, or our content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content on the Site without our prior written consent, except:

Your computer may temporarily store copies in RAM incidental to accessing and viewing the content
You may store files that are automatically cached by your web browser
You may print or download one copy of a reasonable number of pages for personal, non-commercial use

Property listing data displayed on the Site is provided through IDX (Internet Data Exchange) from the Multiple Listing Service (MLS). This data:

Is provided for consumers' personal, non-commercial use only
May not be used for any purpose other than identifying prospective properties you may be interested in purchasing
Is deemed reliable but not guaranteed
May be subject to additional terms from the MLS provider

6. User Submissions

Your Content

Any material, information, or other communication you transmit, post, or submit to the Site ("User Submissions") will be considered non-confidential and non-proprietary, except for personal information covered by our Privacy Policy.

By submitting User Submissions, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

Responsibility for Content

You are solely responsible for your User Submissions and the consequences of posting or publishing them. You represent and warrant that:

You own or have the necessary rights to your User Submissions
Your User Submissions do not violate any third party's rights
Your User Submissions comply with all applicable laws and regulations

7. Real Estate Services

Agency Disclosure

Christy Schmaedeke is a licensed real estate agent in the State of Illinois, operating under Keller Williams Infinity - Elevate Real Estate Team. The nature of our agency relationship (buyer's agent, seller's agent, or dual agent) will be disclosed to you as required by Illinois law before any confidential information is shared.

Not Legal, Financial, or Tax Advice

Information provided through our Services is for general informational purposes only and does not constitute legal, financial, tax, or other professional advice. You should consult with appropriate professionals regarding your specific situation.

Property Information Accuracy

While we strive to provide accurate property information, we do not guarantee the accuracy, completeness, or timeliness of any information on the Site. Property information, including but not limited to square footage, lot size, room dimensions, and features, should be independently verified.

THIS LIMITATION APPLIES WHETHER THE DAMAGES ARISE FROM:

INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESSING THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Christy Schmaedeke, Keller Williams Infinity, and their officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Site or Services
Your violation of these Terms
Your violation of any third party's rights
Your User Submissions
Any real estate transaction in which you participate

11. Telephone Consumer Protection Act (TCPA) Compliance

Consent to Communications

By providing your telephone number to us, you consent to receive calls and text messages from Christy Schmaedeke, REALTOR® regarding real estate services, including:

Property information and listing alerts
Appointment scheduling and reminders
Transaction-related communications
Marketing communications (with separate opt-in consent)

Automated Communications

Some of our communications may be sent using automated telephone dialing systems or prerecorded messages. By providing your phone number and opting in, you consent to receive such communications.

Revoking Consent

You may revoke your consent to receive calls or text messages at any time by:

We will process your opt-out request within ten (10) business days.

Do Not Call Compliance

13. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the Site shall first be attempted to be resolved through good faith negotiation between the parties.

If negotiation fails, any controversy or claim shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Grundy County, Illinois.

Waiver of Class Action

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Jurisdiction

For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Grundy County, Illinois.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

Posting the updated Terms on the Site with a new "Last Updated" date
Sending you an email notification (for registered users)
Providing notice through our SMS program (if applicable)

Your continued use of the Site after any modifications indicates your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Site.

15. Termination

We may terminate or suspend your access to the Site and Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

Your right to use the Site will immediately cease
Any provisions of these Terms that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and indemnification)

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Christy Schmaedeke, REALTOR® regarding your use of the Site and Services, superseding any prior agreements.

19. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
