The Circuit Court is where all criminal felony trials are conducted and where misdemeanor convictions are appealed. Felonies are those crimes punishable by incarceration in a State Penitentiary for at least one year, in addition to possible monetary fines. Misdemeanors are those crimes punishable by incarceration in a Regional Jail for up to one year, in addition to possible monetary fines.
The Circuit Court also hears all civil cases, such as personal injury, malpractice, boundary line disputes, appeals of domestic relations cases from the Family Court, appeals of judgments from Magistrate Court and all other lawsuits brought by individuals and companies.
All orders of the Circuit Court are appealable to the West Virginia State Supreme Court of Appeals.
