PART B: TERMS OF TRADE (SERVICES)

These terms apply specifically when you engage Luke’s plumbing and Gas to perform plumbing works ("Works").

5. QUOTES AND ESTIMATES

5.1. Validity: Written quotes are valid for 30 days from the date of issue. 5.2. Variations: Quotes are based on visible conditions. We reserve the right to amend the Price if variations are required due to unforeseen difficulties (e.g., rock excavation, hidden pipes, poor weather, asbestos) discovered after Works commence. 5.3. Online Estimates: Any pricing mentioned on the Site is a guide only and does not constitute a binding quote until confirmed in writing after a site inspection.

6. PAYMENT TERMS

6.1. Payment Due: Unless otherwise agreed in writing, payment is due immediately upon completion of the Works or receipt of invoice. 6.2. Deposits: We reserve the right to require a non-refundable deposit (e.g., 10-20%) prior to commencing Works or ordering specific materials. 6.3. Late Payment: Failure to pay by the due date may incur interest at a rate of (12months) (RBA rate + 10% pa) per annum, calculated daily, plus any costs associated with debt recovery (including legal and collection agency fees). 6.4. Title: Ownership of any materials supplied (e.g., hot water systems, tapware) remains with Luke’s plumbing and Gas until full payment is received. We reserve the right to enter the premises to reclaim materials if payment is not made, subject to the Personal Property Securities Act 2009 (PPSA).

7. CANCELLATIONS AND ACCESS

7.1. Cancellation: You must provide at least 24 hours’ notice to cancel or reschedule a scheduled appointment. Failure to do so may incur a Call-Out Fee. 7.2. Access: You must ensure we have clear and safe access to the work site. If we arrive and cannot access the property or the area is unsafe (e.g., unrestrained dogs), a Call-Out Fee will apply.

8. WARRANTIES AND DEFECTS

8.1. Workmanship: We warrant our workmanship for a period of 12 months from completion. 8.2. Manufacturers’ Warranty: Materials and appliances (e.g., hot water units) are covered by the manufacturer’s specific warranty. We are not responsible for product faults but will assist in the warranty process where possible. 8.3. Exclusions: Our warranty does not cover blocked drains caused by tree roots or misuse (e.g., flushing foreign objects), or damage caused by third parties or environmental factors. 8.4. Australian Consumer Law: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value.

9. BLOCKED DRAINS DISCLAIMER

9.1. If we are engaged to clear a blocked drain, you acknowledge that there is likely existing damage to the pipework (e.g., cracks or root intrusion). While we will clear the blockage, we cannot guarantee against re-occurrence unless permanent repairs (e.g., relining or excavation) are undertaken.

10. PRIVACY POLICY

10.1. We are committed to protecting your privacy. We collect your personal information (name, address, phone) solely for the purpose of providing our services and invoicing. We will not share your data with third parties unless required by law or for debt collection purposes.
