Pricing guardrails to reduce underbidding risk.

Training, support, and optional add-on services.

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.

3. Eligibility

You must be at least 18 years old to use our Services. By using the Website, you represent and warrant that you have the legal capacity to enter into these Terms.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete information.

Keep your login credentials confidential.

Notify us immediately of unauthorized use of your account.

We reserve the right to suspend or terminate accounts for violations of these Terms.

5. Payment and Subscriptions

- Services are billed as a one-time setup fee and/or monthly retainer, as outlined at purchase.

- Additional order bumps, add-ons, and upsells are billed separately.

- Payments are processed securely through third-party providers.

- All fees are non-refundable unless otherwise stated in writing.

6. Guarantee

We offer a Win Rate Guarantee: If you do not see at least a 10% improvement in bid turnaround speed and win more projects within 90 days, we will continue to work with you at no additional cost until you do.

Guarantee eligibility may require proof of proper system use and cooperation with our onboarding process.

7. Acceptable Use

You agree not to:

- Misuse or reverse-engineer the software.

- Share access credentials with unauthorized users.

- Upload harmful, unlawful, or infringing content.

- Use the Services in any manner that could harm TopQuote.ai, its users, or third parties.

8. Intellectual Property

All content, trademarks, logos, and software provided by TopQuote.ai remain the intellectual property of TopQuote.ai and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for business purposes only.

9. Data & Privacy

Your use of the Services is subject to our Privacy Policy, which governs how we collect, use, and store your information. By using the Website, you consent to the practices described in the Privacy Policy.

10. Disclaimer of Warranties

TopQuote.ai provides its Services “as is” and “as available.” We do not guarantee error-free operation, accuracy of results, or uninterrupted access. You acknowledge that AI-driven outputs may require human oversight and verification.

11. Limitation of Liability

To the fullest extent permitted by law:

TopQuote.ai and its affiliates shall not be liable for indirect, incidental, or consequential damages.

Our maximum liability for any claim related to the Services shall not exceed the total amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold TopQuote.ai, its officers, employees, and affiliates harmless from any claims, damages, liabilities, or expenses arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.

13. Termination

We may suspend or terminate your access to the Services at our discretion, without notice, for conduct that violates these Terms or is harmful to other users or TopQuote.ai.

14. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law principles.

15. Dispute Resolution

. If unresolved, disputes shall be subject to binding arbitration in New York County, NY, under the rules of the American Arbitration Association (AAA).
