1. The Binding Agreement

By visiting this website or purchasing products from Mega Tire Ltd (“we”, “our”, “us”), you (the "Customer") confirm that you have read, understood, and voluntarily accepted these Terms and Conditions. These terms constitute a final and binding contract.

2. Product Illustrations & Design Disclaimer (Critical)

  • Non-Binding Images: All product images and illustrations on this website are provided for general reference only. The actual product delivered may differ slightly or significantly from the image displayed on the page.

  • Design Variations: In some cases, the available physical stock may have a different tread design, sidewall lettering, or aesthetic pattern than the product image shown online.

  • Absolute Liability Waiver: Mega Tyres shall not be held responsible or liable for any discrepancies between the website illustration and the physical product delivered. By completing a purchase, the Customer waives all rights to claim a refund, exchange, or damages based on visual or design variations, provided the tyre meets the technical size specifications ordered.

3. Customer Selection Responsibility

  • Finality of Choice: The final responsibility for ensuring the correct size and fitment for a specific vehicle rests solely with the Customer. Mega Tyres is not liable for fitment errors based on Customer input.

4. Absolute Shipping & Delivery Disclaimer

  • Non-Guaranteed Timelines: All delivery windows are estimates only. Mega Tyres is not liable for any claims of "inconvenience," "loss of time," or "consequential damages" due to delays caused by traffic, weather, or third-party logistics.

  • Destination Selection Error: If the wrong zone is selected, the delivery fee is 100% non-refundable. Rerouting requires a new payment.

  • Default Pickup: Orders without a selected destination must be picked up at: Progressive Block A2, Shop 011/012, African Tyre Village, Trade Fair, Lagos.

5. Payment Terms

  • Bank Transfer: Account details are provided immediately on-screen upon selection. Dispatch occurs only after funds are confirmed in our bank account.

  • Pay on Delivery (POD): Where available, full payment must be made to the agent before the product wrapping is opened or the goods are released.

6. Return & Refund Policy (10-Day Protection)

  • Manufacturing Defects: Covers only verifiable factory defects (e.g., sidewall bulges).

  • Change-of-Mind: Accepted only if the tyre is unmounted, unused, and in its original pristine condition with all factory labels and wrapping 100% intact.

  • Technical Sovereignty: Mega Tyres’ technical team has the exclusive and final right to approve or reject any claim. Their decision is final.

  • Non-Refundable Costs: Shipping fees, bank service charges, and installation fees are strictly non-refundable.

7. Exclusion of Liability (Road Hazards & Usage)

  • Road Condition Waiver: Mega Tyres expressly disclaims all liability for tyre damage caused by road hazards (potholes, glass, curb impacts, etc.).

  • Third-Party Installation: We are not liable for damage caused by external vulcanizers or mechanics.

  • Liability Cap: The total liability of Mega Tyres shall not exceed the actual purchase price paid for the specific item.

8. Governing Law & Mandatory Mediation

  • Jurisdiction: This agreement is governed by the laws of the Federal Republic of Nigeria.

  • Mandatory Mediation: Parties must attempt to resolve disputes via mediation in Lagos for at least 30 days before filing any court action.

  • Venue: Any legal proceedings shall be held exclusively in the courts of Lagos State
