1. Acceptance of Terms

 

By accessing or using the website, services, and content (collectively, the “Services”) of Royal Rejuvenation Aesthetics and Wellness PLLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service/Use (“Terms”) and our Privacy Policy. If you do not agree, you may not access or use the Services.

 

2. Nature of Services (Critical Disclaimers)

 

A. NO MEDICAL EMERGENCY SERVICES: The Services are not for medical emergencies. If you are experiencing a medical emergency, you must immediately dial 911 or go to the nearest emergency room.

B. TELEMEDICINE AND VIRTUAL CARE: Our Services may include virtual consultations, medical assessments, and treatment plans (“Telemedicine Services”) provided by independent, licensed healthcare professionals (the “Providers”).

You acknowledge that Telemedicine Services do not replace in-person primary or specialist care.

You understand that the diagnosis and treatment you receive rely entirely on the information you provide. You agree to provide accurate, complete, and current health information.

The Provider, using their independent medical judgment, has the sole authority to determine the appropriateness of any service, prescription, or treatment, including the prescribing of medications such as GLP-1 agonists (e.g., Semaglutide/Tirzepatide).

You have the right to withhold or withdraw consent to Telemedicine Services at any time without affecting your right to future care.

C. LIMITATION OF LIABILITY (COMPANY vs. PROVIDER): The Company operates a platform that facilitates the connection between you and the Providers. The Company does not practice medicine or provide healthcare services. You understand and agree that the Providers are solely responsible for all medical care, diagnosis, advice, and treatment provided to you. The Company disclaims all liability for the professional services rendered by the Providers.

 

3. Patient Responsibilities

 

A. Primary Care and Other Providers: You are responsible for maintaining a relationship with a primary care physician and consulting with them regarding your participation in any treatment program, including GLP-1 therapy.

B. Review of Information: You confirm that you have been fully informed of the risks, benefits, and alternatives of any treatment prescribed, including potential side effects, and have had the opportunity to ask questions.

C. Medication Handling & Shipping (If Applicable): You acknowledge and accept that:

You are responsible for the safe and prompt acceptance and refrigeration of any compounded medication upon delivery.

The Company and its pharmacy partners are not liable for lost, stolen, or damaged medication due to your failure to retrieve it promptly or provide a correct shipping address.

All sales are final, and no refunds or returns are permitted on dispensed prescription medication.

D. Security: You are responsible for maintaining the confidentiality of your account information, login credentials, and any protected health information (PHI) once it is downloaded or transmitted to your personal device.

 

4. Payment and Billing

 

A. Fees: You agree to pay all fees for the Services as outlined on our website or within your specific patient agreement. All payments are due at the time of service unless otherwise agreed.

B. Insurance: We do not bill your health insurance. You are solely responsible for all costs related to services we offer.

C. Subscription/Membership (If Applicable): If your plan involves a recurring membership fee, you authorize the Company to charge your provided payment method on a recurring basis until you cancel the service in accordance with our stated cancellation policy.

 

5. Privacy and Security (HIPAA)

 

A. HIPAA Compliance: We and the Providers are committed to protecting your medical information. We adhere to the requirements of the Health Insurance Portability and Accountability Act (HIPAA) and other applicable privacy laws.

B. Notice of Privacy Practices (NPP): Our collection, use, and disclosure of your Protected Health Information (PHI) are governed by our separate Notice of Privacy Practices (NPP), which is available on our website and which you agree to review.

 

6. Governing Law and Dispute Resolution

 

A. Governing Law: These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

B. Arbitration: Any dispute or claim arising out of or relating to these Terms or the Services shall be settled by binding arbitration in Texas under the rules of the American Arbitration Association, and not in a court of law.

 

7. Termination

 

The Company reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or for failure to pay for services rendered. The Providers retain the right to terminate the patient-provider relationship for any clinically appropriate reason, including non-compliance with the treatment plan.
